CLOSING AND ABANDONING A 5 -FOOT RIGHT-OF-WAY ALONG
THE NORTH SIDE OF 60 -FOOT WIDE TIMBERGROVE LANE AND
ADJACENT TO BLOCKS 1, 3 AND 5, AND ALONG THE SOUTH
SIDE OF TIMBERGROVE LANE AND ADJACENT TO BLOCKS 4
AND 6, JACKSON PLACE, REVERTING SAID 5 -FOOT WIDE
PORTIONS OF RIGHT-OF-WAY TO ABUTTING OWNERS AND
RETAINING AS DRAINAGE EASEMENT THE 30 -FOOT SECTIONS
OF SAID 5 -FOOT RIGHT-OF-WAY CENTERED BETWEEN LOTS 23
AND 24, BLOCK 5, LOTS 12 AND 13, BLOCK 4, LOTS 15
AND 16, BLOCK 5, AND LOTS 1 AND 2, BLOCK 6, JACKSON
PLACE, A MAP OF WHICH IS RECORDED IN VOLUME 23, PAGE
90, MAP RECORDS OF NUECES COUNTY, TEXAS; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 5 -foot right-of-way along both sides of
Timbergrove Lane; and
WHEREAS, it has been determined that it is feasible and advan-
tageous to the City of Corpus Christi to abandon said easement:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the 5 -foot right-of-way along the north side of
60 -foot wide Timbergrove Lane and adjacent to Blocks 1, 3 and 5, and along
the south side of Timbergrove Lane and adjacent to Blocks 4 and 6, Jackson
Place, be and the same is hereby closed and abandoned and that said 5 -foot
wide portions of right-of-way revert to the abutting owners, retaining as
drainage easement the 30 -foot sections of said 5 -foot right-of-way centered
between Lots 23 and 24, Block 5, Lots 12 and 13, Block 4, Lots 15 and 16,
Block 5, and Lots 1 and 2, Block 6, Jackson Place, a map of which is recorded
in Volume 23, page 90, Map Records of Nueces County, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.

SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the public
convenience and necessity would be better served by the closing of the afore-
said easement, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
or resolutions at three regular meetings so that this ordinance is passed
and shall take effect upon first reading as an emergency measure this /q
day of August, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
