TEXAS:
AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH THE DEVELOPER OF LOTS 1 AND 2, BLOCK 10, CAYO
PLACE FOR THE EXTENSION OF AN EIGHT INCH WATER SUPPLY
MAIN FROM THE WESTERN BOUNDARY OF OAK HARBOR SUBDI-
VISION ALONG THE FRONTAGE OF CAYO PLACE BY THE CITY
IN CONSIDERATION OF THE PAYMENT OF $7,600; PROVIDING
FOR PLAT APPROVAL, ISSUANCE OF BUILDING PERMITS, AND
OTHER CONDITIONS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with the developer of Lots 1 and 2, Block 10, Cayo
Place for the extension of an eight inch water supply main from the west-
ern boundary of Oak Harbor Subdivision along the frontage of Cayo Place by
the City in consideration of the payment of $7,600.
SECTION 2. That the City will approve the final plat of Cayo
Place, Block 10, Lots 1 and 2 and issue a building permit upon execution of
this contract, a substantial copy of which is attached hereto and made a
part hereof, marked Exhibit "A".
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to public con-
venience and necessity of extending the water supply main, such finding of
an emergency is made and declared requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings so that this ordinance is passed and shall take effect
upon first reading as an emergency measure this

AGREEMENT

THIS AGREEMENT is entered into between the City of Corpus Christi,
hereinafter called "City", and Joe Adame, hereinafter called "Developer".
WHEREAS, the Developer in compliance with the City's Platting
Ordinance is developing Cayo Place, Block 10, Lots 1 and 2, and;
WHEREAS, in order to meet the requirements of the Platting Ordin-
ance, Developer must construct a 6 -inch water line from the western boundary
Oak Harbor Subdivision across the entire frontage of Cayo Place, and;
WHEREAS, the water line to the western boundary of Oak Harbor Sub-
division is to be constructed by others, and;
WHEREAS, Developer desires to proceed with the platting of his
property and to acquire building permits for construction of a residence.
NOW, THEREFORE, THE City and the Developer agree as follows:
1) Developer agrees to pay City the actual cost of construction,
now estimated at $7,600, prior to a tap being issued for any of the lots in
Cayo Place, Block 10. No tap will be made until payment is made to the City.
The actual cost is not to include engineering.
2) The City will construct an 8 -inch line in lieu of the 6 -inch
line and such line will be completed within 12 months of the date of execu-
tion of this contract.
3) City will approve final plat of Cayo Place, Block 10, Lots 1
and 2 and issue a building permit upon execution of this contract.
4) The Agreement shall become effective and be binding upon and
inure to the benefit of the parties hereto and their respective heirs,
successors and assigns from and after the date execution.
