STEVENS LEVEE; TRANSFERRING $85,000 FROM THE NO. 141 WATER FUND RESERVE, DEPARTMENT 361, ACTIVITY 541.99, TO THE HURRICANE ALLEN DAMAGE AC- COUNT, DEPARTMENT 361, ACTIVITY 541.91, AND APPRO- PRIATING SAID $85,000 OUT OF THE NO. 141 WATER FUND, DEPARTMENT 361, ACTIVITY 541.91 (HURRICANE ALLEN DAMAGE) OF WHICH $79,080 IS FOR THE CONTRACT AWARD AND $5,920 IS FOR ADDITIONAL ENGINEERING, LEGAL AD- VERTISING AND CONTINGENCY AND RELATED EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with DeBer, Inc., of Corpus Christi for reconstruction of the O.N. Stevens Levee, damaged by Hurricane Allen, all as more fully set forth in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of DeBer, Inc., opened on the 12th day of August, 1981, said bid being the lowest and most advantageous to the City of Corpus Christi, Texas. SECTION 2. That there is hereby authorized a transfer of $85,000 from the No. 151 Water Fund Reserve, Department 361, Activity 541.99, to the Hurricane Alien Damage Account, Department 361, Activity 541.91, and that said $85,000 is hereby appropriated out of the No. 151 Water Fund, Department 361, Activity 541.91 (Hurricane Allen Damage) of which $79,080 is for the contract award and $5,920 is for additional engineering, legal advertising and contingency and related expenses. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to public con- venience and necessity of the aforesaid reconstruction, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first 18494 MICROFILMED' SEP 2 71884 a reading as an emergency measure this 21, day of August, 1981.
