HomeMy WebLinkAbout16498 ORD - 08/26/1981sp;8/25/81;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH NUECES COUNTY, TEXAS, FOR THE OPERATION OF THE NUECES COUNTY'S HILLTOP COMMUNITY CENTER FOR THE PUR- POSE OF PROVIDING CORPUS CHRISTI CITIZENS IN THE HILLTOP AREA AN OPERATING COMMUNITY CENTER, A SUB- STANTIAL COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; SUCH CENTER TO BE OPERATED BY THE COUNTY FOR 12 MONTHS AT A COMPENSATION OF $10,000, PAYMENTS TO BE MADE ON A MONTHLY BASIS OF $834; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Nueces County, Texas, for the operation of the Nueces County's Hilltop Community Center for the purpose of providing Corpus Christi citizens in the Hilltop area an operating community center, a substantial copy of which agreement is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That such center is to be operated by the County for 12 months at a compensation of $10,000, payments to be made on a monthly basis of $834. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to public con- venience and necessity for operating the aforesaid center, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regu- lar meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this 24 day of August, 1981. ATTEST: C' y Secretary APPROVED? ?DAY OF AUGUST, 1981 J /Bruc Aycock, Cit Attorney MA'0 THE CITY OF CORPUS CHRISTI, TEXAS 16488 MICROFILMED SEP 2 71984 THE STATE OF TEXAS X COUNTY OF TEXAS X This Agreement by and between referred to as Christi, Texas, AGREEMENT made and entered into this the day of , 1981, the City of Corpus Christi, a municipal corporation, hereinafter "City", and the County of Nueces, 901 Leopard Street, Corpus hereinafter called "County": Witneaseth WHEREAS, the operation of a Community Center and the associated opportunities generated for community services are legitimate objectives of the County and City; and, WHEREAS, these objectives can be achieved more fully in use, maintenance and sponsoring of a Community Center at the Nueces County Hilltop facility; NOW, THEREFORE, the City and County enter into the following Agreement: 1. The County will operate the Nueces County Hilltop Community Center for the benefit and enjoyment of the citizens of Nueces County for a period of twelve months, beginning July 1, 1981. 2. The City agrees to pay the County Ten Thousand Dollars, to be paid at the rate of Eight Hundred Thirty Four Dollars per month on or about the 15th day of each month without receipt of any formal request from County. 3. County agrees to notify City to reduce its payment if, at the end of any month, County's expenditures for the Hilltop Center from the effective date of this contract are not at a level at least twice the City's requested payment. 4. Either party may cancel this Agreement by providing the other party sixty days notice. Witness our hand at Corpus Christi, Texas, this the 4day of2L. 1981.
