HomeMy WebLinkAbout16521 ORD - 09/09/1981sp;9/8/81;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS FOR THE ACQUISITION OF PARCEL 9, A DRAINAGE EASEMENT, FOR THE WOOLDRIDGE-STAPLES DRAINAGE OUTFALL PHASE I, PROJECT 295-70-66; APPROPRIATING $2,100 OUT OF THE NO. 295 STORM SEWER BOND FUND FOR ACQUISITION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute the necessary documents for the acquisition of Parcel 9, a drain- age easement, for the Wooldridge -Staples Drainage Outfall Phase I, Project No. 295-70-66, all as more fully set forth in the documents, a substantial copy of which is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That there is hereby appropriated $2,100 out of the No. 295 Storm Sewer Bond Fund, Project No. 295-70-66, Wooldridge -Staples Drainage Outfall Phase I, for acquisition of Parcel 9. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the public necessity of the drainage outfall project, such finding of an emergency is made and declared requiring suspension of the Charter rule as to considera- tion and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this 9 day of September, 1981. Together with the free ingress, egress, and regress to and for the City of Corpus Christi, Texas, for the purpose of constructing a public drainage facility, and for the purposes of maintaining, servicing, repa_ring, and inspecting said public drainage facility under, on, and along said tract. TO HAVE 3ND TO HOLD, all and singular, the r'_g,ts and privilees aforesaid to the City of Corpus Christi, Texas, its successors and legal representa- tives, for the proper use as a drainage easement and drainage right-of—way, for so long as used for such purpose, and if the use for said easement and way of said uses be ever abandoned, then in that event, the aforesaid rights and privileges shall cease.
