HomeMy WebLinkAbout16524 ORD - 09/09/1981sp/9/8;81; 1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A FIVE YEAR LEASE AGREEMENT WITH THE TRACT 16 NEIGHBORHOOD COUNCIL FOR THE LEASING TO THE COUNCIL THE PROPERTY AT 2835 BLAKE STREET FOR USE AS A COMMUNITY CENTER, ALL AS MORE FULLY SET FORTH IN THE LEASE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a five year lease agreement with the Tract 16 Neighborhood Council for the leasing to the Council the property at 2835 Blake Street for use as a Community Center, all as more fully set forth in the lease agreement, a sub- stantial copy of which is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the public necessity of operating a Community Center, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emer- gency measure this I day of September, 1981. ATTEST: y Secret • y AP,RR�VED: 0I�'�' DAY OF SEPTEMBER, 1981 4ecock,jity Attorney 16524 THE CI Y OF CORPUS CHRISTI, TEXAS MICROFILM SEP .?7 1984 LEASE AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES THIS AGREEMENT, made and enter_d into this the day of , 1981, by and between the CITY OF CORPUS CHRISTI, TEXAS, a municipal corporation, hereinafter called "City", and TRACT 16 NEIGHBORHOOD COUNCIL, INC., Corpus Christi, Texas, hereinafter referred to as "Lessee", a non-profit organization operating for the purpose of providing community services: W ITNESSET H: That the City, for and in consideration of the sum of One Dollar ($1.00), and other good and valuable considerations,the receipt and sufficiency of which is hereby acknowledged, does by these presents lease and demise unto Lessee, the following described piece or parcel of land, located in Nueces County, Texas, being more par- ticularly described as follows, to -wit: W. K. Blake Subdivision, Lot 7D, being a replat of a portion of Lot 7, W. K. Blake Subdivision, as recorded in Volume 4, page 35, Nueces County Map Records. The term of this lease shall be for five (5) years, beginning upon execution hereof by the City and ending five (5) years from said date, subject, however, to the right of either party to cancel said lease by giving thirty (30) days written notice to the other party, and further subject to the following covenants and conditions: 1. Lessee does, by these presents and.by entering upon the land, agree to maintain the land and premises during the term of this lease in a clean and sanitary condition, and at the expiration thereof to return said premises to the City in as good a condition as received, reasonable use, wear, acts of God, fire and flood, damage and destruction excepted. 2. Lessee agrees to abide by the following covenants: A, City shall not be liable for any reason under any circumstances to any member of the public nor to any member of the Lessee organization or its guests. B. Lessee agrees to pay for all utilities used by it on said premises or used by any other activities sponsored by said Lessee on said premises. C. Lessee does hereby agree to promptly execute and fulfill all of the ordinances of the City pertaining to health, sanitation and to execute and fulfill all ordinances, orders and requirements imposed by the Health, Sanitation, Fire and Police Departments, for the correction, prevention and abatement of nuisances and/or cards in,. upon or connected with the operation of the corporation on said pre1Ais.. at Lessee's own expense. D. Lessee does hereby agree that the City shall not be responsible for damages to property or injury to persons which may arise incident to the exercise of the rights and privileges herein granted. Lessee further agrees to indemnify and to hold the City harmless from any loss•or damage that may occur upon said premises which loss or damage arises by reason of or is connected with Lessee's use of said premises. E. Lessee does hereby agree that the City shall not be responsible for any obligation of indebtedness that may be created by Lessee which obligation arises by reason of or is connected with Lessee's use of said premises. F. It is agreed that Lessee shall at the end of the term of this lease remove any and all improvements placed on said premises by Lessee, unless the lease is extended or renewed. Should Lessee fail to remove said improvement within sixty days (60) from the date of termination, the improvements shall become the property of City with all the rights and privileges attached thereto.
