HomeMy WebLinkAbout16540 ORD - 09/16/1981,7kh:9-16-81;1st 440 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29th DAY OF MARCH 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING THERETO A NEW SUBSECTION TO SECTION 31-5, TO BE NUMBERED 31-5.32, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID AREA BEING DESCRIBED AS A TRACT OF 113.98 ACRES OF LAND OUT OF LOTS 9 THROUGH 14, SECTION 6, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, A MAP OF WHICH IS RECORDED IN VOLUME "A", PAGES 41, 42 AND 43, MAP RECORDS OF NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on September 16, 1981, at Regular Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Carpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of Planned Unit Development -2 "PUD -2" on the parcel or tract of land, more fully described hereinafter, containing 113.98 acres, out of Lot 9 through 14, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume "A", pages 41, 42 and 43, Map Records of Nueces County, Texas, situated in Nueces County, Texas; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning; 1.6510 MICROFILMED SEP ? 71.984 (3) That the permanent zoning as hereinabove set forth be granted to the aforesaid described and hereinafter more fully described parcel or tract of land; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 575 et seq of the Ordinance and Resolution Records, as amended from time to time, and particularly as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be and the same is hereby, amended by making the change hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5, by adding a new subsection, 31-5.32, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: "Section 31-5.32 The following described tract of land shall be zoned and classified as Planned Unit Development -2 "PUD -2" for a residential development: Being a 113.98 acre tract of land out of Lots 9 through 14, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume "A", pages 41, 42 and 43, Map Records of Nueces County, Texas: BEGINNING at an axle found at the intersection of the Northwest right-of- way line of South Staples Street with the Northeast boundary line of said Lot 9 for the East corner of this survey from which corner the East corner of said Lot 9 in the centerline of South Staples Street bears South 61°03'00" East 40.00 feet; THENCE South 28°56'00" West, along the aforementioned Northwest right-of- way, parallel to the centerline thereof and 40.00 feet distant therefrom, measured at right angles thereto, 1,265.52 feet for the South corner of this survey; THENCE North 61°01'10" West, crossing through Lots 9, 10, 11, 12, 13, 14, 3,926.30 feet to a point on the Northwest boundary line of Lot 14 for the West corner of this survey; -2- THENCE North 28°55'30" East, along the aforementioned Northwest line, 1,263.40 feet to a 5/8 inch iron rod found in an 8 inch diameter hole in a 2 foot diameter piece of concrete, marking the North corner of said Lot 14 and the North corner of this survey; THENCE South 61°03'00" East, along the Northeast line of Lots 14 thru 9, 3,926.50 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the it/(.2 day of September, 1981.
