Home My WebLink About16546 ORD - 09/23/1981sp;9/21/81;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH CHAMPLIN PETROLEUM COMPANY PROVIDING FOR INSTALL- ATION OF AN OVERSIZED WATER TRANSMISSION LINE IN SOUTHERN MINERALS ROAD WHICH AUTHORIZES CHAMPLIN TO CONSTRUCT THE LINE AND PROVIDES FOR THE CITY TO SUPPLY THE PIPE AND FITTINGS, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Champlin Petroleum Company providing for in- stallation of an oversized water transmission line in Southern Minerals Road which authorizes Champlin to construct the line and provides for the City to supply the pipe and fittings, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to public con- venience and necessity of installation of an oversized water transmission line, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or reso- lutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this 23 day of September, 1981. ATTEST: Ci Secretary D: AY OF SEPTEMBER, 1981 J jBruc& Aycock, Cit j Attorney 16546 THE CITY OF CORPUS CHRISTI, TEXAS SEP 2 7 1984 MICROFILMED' AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES I This agreement is authorized by Ordinance No. and entered into by and between the City of Corpus Christi, Texas a municipal corporation, hereinafter called "City", and Champlin Petroleum Company, a Texas corporation, hereinafter referred to as "Developer", and pertains to joint participation in the construction of a water main as an extension of the City water system in Southern Minerals Road between Up River Road and Interstate Highway 37. WHEREAS: Champlin Petroleum Company is constructing a new plant immediately east of Southern Minerals Road between Up River Road and Interstate Highway 37 adjacent to the City limits and, WHEREAS: It has been determined that the Champlin Petroleum Company water demand would require a 12 inch diameter waterline along this portion of the City water system and, WHEREAS: It has been determined that it is in the public interest to con- struct a 24" diameter water line in Southern Minerals Road from Up River Road to Interstate Highway 37. NOW THEREFORE, for and in consideration of the mutual convenants and con- ditions herein exchanged and agreed to be kept and performed, the City and the developer agree as follows: - 1. Developer will submit plans and specifications to the City providing for the construction of a 24" diameter waterline in Southern Minerals Road from Up River Road to near Interstate Highway 37 and will construct said waterline at Developers expense, except as provided herein, and as shown on attached Exhibit "B". 2. City will provide, at City cost, approximately 2,300 L.F. of 24" ductile iron pipe and fittings as shown on the attached Exhibit "A". City will deliver pipe and material to job site on 48 hour notice. 3. As Developer is exempted from usual City platting requirements which would otherwise provide for Developer dedicating right-of-way in Southern Minerals Road, and in consideration of the furnishing and use of City water, Champlin hereby agrees to dedicate 10 foot of right-of-way along the total plant site frontage on Southern Minerals Road. Developer further agrees to dedicate such right-of-way within 60 calendar days of date of City approval of this instrument. Developer and City agree that said 24" water line will be constructed in the 10 foot right-of-way to be nit* M1 dedicated. 4. The Developer agrees to indemnify the City against any claims arising as a result of the project. 5. This agreement shall be executed in duplicate, both of which shall be considered one instrument. When both of the duplicates have been executed by the City, and at least one duplicate has been executed by the Developer, this agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors and assigns.
