HomeMy WebLinkAbout16554 ORD - 09/23/1981AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE INDUSTRIAL DISTRICT AGREEMENT WITH CHAMPLIN PETROLEUM COMPANY, AUTHORIZED BY ORDINANCE NO. 16155, TO INCLUDE APPROXIMATELY 3.5 ACRES OF ADDITIONAL LAND AND PROPERTY ACQUIRED AFTER JANUARY 1, 1981, BY REVISING EXHIBIT "A" ACCORDINGLY, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT TO INDUSTRIAL DISTRICT AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO; AND DECLARING AN EMERGENCY. WHEREAS, Champlin Petroleum Company and the City of Corpus Christi have entered into an industrial district agreement, approved by the City Council of the City of Corpus Christi by Ordinance No. 16155; and WHEREAS, Champlin Petroleum Company has acquired approximately 3.5 acres of land after January 1, 1981 within the extraterritorial juris- diction of the City, the use of which relates directly to the primary use of the parent tract; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and is hereby authorized, pursuant to Article III (a) of the industrial district agreement with Champlin Petroleum Company, authorized by Ordinance No. 16155, to execute an amendment to the aforesaid industrial district agreement to include approximately 3.5 acres of additional land and property by revising Exhibit "A" of the industrial district agreement with Champlin Petroleum Company. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing an industrial district agreement amendment with Champlin Petroleum Company prior to an annexation election, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency this day of September, 1981. The City of Corpus Christi and Company agree that the attached revision to Exhibit "A" consisting of a description and map of an approximately 3.5 -acre tract acquired by Company after January 1, 1981 shall be included within and subject to the Company's industrial district agreement authorized by Ordinance No. 16155 . Company warrants to the City that the use of the subject 3.5 -acre tract relates directly to the primary use of the parent tract described under the original industrial district agreement. Field note description of the additional land 2. Survey of the additional land 3. An outline of the additional land on a portion of original Exhibit A to the referenced Industrial District Agreement. If the foregoing is satisfactory to incorporate said additional land in the Champlin Petroleum Company Industrial District, please acknowledge same by returning to me a copy of this letter signed and dated by an appropriate City Official. Morrison 1 REVISION TO EXHIBIT "A" FIRST ADDITION TO EXHIBIT A Industrial District Agreement Between Champlin Petroleum Company and the City of Corpus Christi Property acquired by Champlin Petroleum Company on September 3, 1481: Being a tract of land situated in Nueces County, Texas out of the W.W. Walton, Jr. lands out of Fractional Section 9, Range 9, of the H.L. Kinney Sectionalized Lands in the Enrique Villarreal Grant, Abstract 1, and being more particularity described by metes and bounds as follows: BEGINNING at a point in the south right -9f -way line of Up River Road whence the northwest cor- ner of a 232.436 acre tract purchased by Champlin Petroleum Company from W.W. Walton, Jr. bears N 76° 43' 42" W, 424.32 feet, and N 74° 06' 39" W. 823.89 feet, for the northwest corner of this tract said point being a corner of the 232.436 acre Champlin Tract and the northwest corner of the tract conveyed to Acme Well Service by W.W.
