PARKS AND PLAYGROUNDS, PARAGRAPH (d) SO AS NOT TO REQUIRE PARK DEDI- CATION FOR PLATS OF ONE -FAMILY RESIDENTIAL AREAS OF FIVE (5) ACRES OR MORE, IN WHICH NOT MORE THAN ONE LOT IS CREATED, PROVIDED A NOTE IS PLACED ON THE PLAT INDICATING THAT THE AREA ENCOMPASSED WITHIN THE PLAT HAS NOT SATIS- FIED THE PARK REQUIREMENTS OF THE PLATTING ORDINANCE AND THAT THE PARK REQUIREMENT WILL BE SATISFIED UPON SUBDIVI- SION OF THE PROPERTY OR DEVELOPMENT OF THE PROPERTY FOR OTHER THAN ONE -FAMILY PURPOSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Platting Ordinance No. 4168, as amended, be amended by amending Section IV DESIGN STANDARDS, Subsection F. PARKS AND PLAYGROUNDS, paragraph (d), said paragraph (d) to hereafter read as follows: "(d) The above subsections (a), (b) and (c) shall not apply in the following cases: (i) A replat of an existing platted area which has previously satisfied the park requirement, or (ii) For plats of one -family residential areas of five (5) acres or more, in which not more than one (1) lot is created, provided a note is placed on the plat indicating that the area encompassed within the plat has not satisfied the park requirements of the Corpus Christi Platting Ordinance Number 4168 as amended, and the park• requirement will be satisfied upon the subdivision of the property or develop- ment of the property for other than one single-family dwelling, or (iii) For any property which was improved for purposes other than agricultural uses prior to March 15, 1963 and not being subdivided, or (iv) For land utilized for uses allowed only within the 'I-2' Light Industrial or 'I-3' Heavy Industrial Zoning Districts and zoned 'I-2' or 'I-3' if inside the City of Corpus Christi. The owners of such 'I-2' or 'I-3' property shall execute a contract with the city which shall be a covenant running with the land and be filed in the county deed records. Such contract shall stipulate the per -acre value to be used to meet park dedication requirements if such land is ever developed with a use not listed in the 'I-2' or 'I-3' Zoning District regulations; said owner of any lot so restricted shall be required to pay into the City's Park Development Fund monies equivalent to the raw SEP 2 71984 MICROFILMED 16567 land value of five percent (5%) of the area of the lot which is measured and calculated to the centerline of any street bounding said lot plus 6% interest from the time of filing of the plat of the subdivision, said deposit to be made at the time building and/or occupancy permit fees are paid." SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs, by postponing requirement of park dedication for plats of one -family residential areas of five acres or more until the property is subdivided or developed for other than one -family of an emergency is made and declared requiring sus - rule as to consideration and voting upon ordinances purposes, such finding pension of the Charter or resolutions at three regular meetings so that this ordinance is passed t upon first reading as an emergency measure this the 1981. and shall take of 431,41day of ATTEST: APPROVED: 2.3, f{ DAY OF SEPTEMBER, 1981: J.
