AN ORDINANCE
CLOSING AND ABANDONING THAT PORTION OF THE 15 -FOOT
WIDE UTILITY EASEMENT IN LOTS 1, 2, 3, 4, 14, 15 AND
16, BLOCK B-5, PORT AYERS SUBURBAN CENTER, AS MORE
FULLY ILLUSTRATED ON EXHIBIT "A",THE 8 -INCH SANITARY
SEWER IN SAID EASEMENT TO REVERT TO A PRIVATE LINE,AND
PROVIDING FOR THE UPSTREAM MANHOLE IN THE EASEMENT
TO BE REMOVED WITH MANHOLE RING AND COVER AND DELIVERED
TO THE WASTEWATER SERVICES SUPERINTENDENT, SAID ABANDON-
MENT BEING CONDITIONED FURTHER UPON REPLATTING BY THE
OWNER OF THE LOTS INTO ONE LOT; PROVIDING FOR SEVERANCE;
AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 15 -foot wide utility easement in Lots 1,
2, 3, 4, 14, 15 and 16, Block B-5, Port Ayers Suburban Center, more fully
described by metes and bounds and as illustrated on Exhibit "A" Attached
hereto; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon the hereinafter described utility
easement, subject to replatting of the said lots into one lot at the owner's
expense, and subject further to the removal of -the upstream manhole in the
easement, said manhole ring and cover to be delivered to the Superintendent
of Wastewater Services:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the hereinafter more fully described 15 -foot wide
utility easement be and the same is hereby closed for public use and every
municipal purpose, subject to replatting of the said lots by the owner at the
owner's expense into one lot and subject further to the removal of the upstream
manhole in the easement, said manhole ring and cover to be delivered to the
Superintendent of Wastewater Services, said easement being described as follows:
Being a 15 -foot wide utility easement out of Lots 1, 2,
3, 4, 14, 15 and 16, Block B-5, Port Ayers Suburban
Center, a map of which is recorded in Volume 45, pages 91
and 92, Map Records of Nueces County, Texas:
BEGINNING at a point on the South line of an existing 10.00 foot wide
utility easement for the Northwest corner of this easement, from which corner
the Northwest corner of said Lot 1, Block B-5, bears North 00°56'10" West
10.03 feet and North 86°27'40" West 116.33 feet;
THENCE South 86°27'40" East along the South line of the aforementioned
10.00 foot wide easement 15.05 feet for the Northeast corner of this easement;
THENCE South 00°56'10" East, along the East line of an existing 15.00
foot wide easement, 190.55 feet for a corner of this easement;

THENCE South 07°48'20" West, along the aforementioned East line, 82.35
feet for the Southeast corner of this easement;
THENCE North 82°11'40" West, at 7.50 feet pass the common lot line of said
Lots 4 and 14, Block B-5, in all a distance of 15.00 feet for the Southwest
corner of this easement;
THENCE North 07°48'20" East along the West line of said 15.00 foot easement
81.20 feet for a corner of this easement;
THENCE North 00°56'10" West along the aforementioned line 190.57 feet to
the POINT OF BEGINNING;
the said 8 -inch sanitary sewer in said easement to revert to a private line.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinanceshall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause, phrase,
_word or provision of this ordinance for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five
Council members, copy attached, to find and declare an emergency to close
and abandon the hereinabove described utility easement subject to the condi-
tions set forth in order to effect efficient administration of City affairs,
such finding of an emergency is made and declared requiring suspension of
the Charter rule as to consideration and voting upon ordinances or resolutions
at three regular meetings so that this ordinance is passed and shall take

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
