HomeMy WebLinkAbout16572 ORD - 09/30/1981mb;9/28/81;lst • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS FOR THE ACQUISITION OF PARCEL 10, A DRAINAGE EASEMENT FOR THE WOOLDRIDGE-STAPLES DRAINAGE OUTFALL - PHASE I, PROJECT 295-70-66; APPROPRIATING OUT OF THE N0. 295 STORM SEWER BOND FUND, $2,100 FOR ACQUISITION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute the necessary documents for the acquisition of Parcel 10, a drainage easement for the Wooldridge -Staples Drainage Outfall -Phase I, Project 295-70-66, all as more fully set forth in the documents, a sub- stantial copy of which drainage easement is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That there is hereby appropriated out of the No. 295 Storm Sewer Bond Fund, $2,100 for acquisition. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to acquire the property necessary for the Wooldridge -Staples Drainage Outfall -Phase I as soon as possible, in order to complete the needed public improvements, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take ect upon first reading as an emergency measure this ,43(j day of , 1981. Taylor, of the County of Nueces, State of Texas, for and in consideration of the sum of two THOUSAND ONE HUNDRED DOLLARS AND NO CENTS ($2,100.00) • to me (us) in hand paid by the City of Corpus Christi, Nueces county, Texas, the receipt of which is hereby acknowledged, have granted and conveyed, and by these presents do grant and convey unto the City of Corpus Christi, Texas, a municipal corporation duly incorporated under and by virtue of the laws of the State of Texas, its successors and legal representatives the free and uninterrupted use, liberty, privi- lege, and easement of going in, on, over, under, and along a certain tract of land situated in Nueces County, Texas, and being described as follows: Being a rectangularly shaped tract of land out of Lot B, Block 29, Bass Subdivision as shown by map of record in Volume 7, Page 17, Map Records, Nueces County, Texas and more particularly des.. --- cribed by metes and bounds as follows: Beginning at point being the north corner of abovementioned Lot B; Thence S. 60' 55' 30" E., along the northeast line of Lot B, a distance of 132.0 feet to a point, said point being the east corner of Lot B; Thence S. 29° 04' 30" W., along the southeast line of Lot B, a distance of 55.0 feet to a point; Thence N. 60' 55' 30" W., along a line that is 55.0 feet southwest of and parallel to the northeast line of Lot B, a distance of 132.0 feet to a point, said point being on the northwest line of Lot B; Thence N. 29' 04' 30" E., along the northwest line of Lot B, a distance of 55.0 feet to the point of beginning and containing 0.166 acres, more or less. Together with the free ingress, egress, and regress to and for the City of Corpus Christi, Texas, for the purpose of constructing a public drain- age facility, and for the purposes of maintaining, servicing, repairing, and inspecting said public drainage facility under, on, and along said tract. TO HAVE AND TO HOLD, all and singular, the rights and privileges afore- said to the City of Corpus Christi, Texas, its successors and legal re- presentatives, for the proper use as a drainage easement and drainAge right-of-way, for so long as used for such purpose, and if the use for said easement and way of said uses be ever abandoned, then in that event, the aforesaid rights and privileges shall cease.
