HomeMy WebLinkAbout16586 ORD - 10/07/1981sp;9/25A81;1s°t AN ORDINANCE AMENDING CHAPTER 49 STREETS AND SIDEWALKS OF THE CORPUS CHRISTI CITY CODE, AS AMENDED, BY ADDING A NEW SECTION, TO BE NUMBERED 49-24 TO PROVIDE FOR RELEASE OF ALL SPECIAL ASSESSMENTS OWED TO THE CITY WHICH WERE INCURRED PRIOR TO SEPTEMBER 13, 1950, PURSUANT TO THE AUTHORITY OF ARTICLE 1105b, REVISED CIVIL STATUTES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 49 Streets and Sidewalks of the Corpus Christi City Code, as amended, be amended by adding a new section to be numbered 49-24 to provide for release of all special assessments owed to the City which were incurred prior to September 13, 1950, pursuant to the authority of Article 1105b, Revised Civil Statutes, said section to read as follows: Section 49-24. All special assessments owed to the City which were made on or before September 13, 1950, pursuant to ordinance under authority of Article 1105b of the Revised Civil Statutes are declared void and without force or effect. Nothing in this ordinance shall be construed to release, abrogate, or modify debts or obligations owed to any person, corporation or entity other than the City of Corpus Christi. This ordinance shall be filed in the records of the County Clerk of Nueces County. Such recording shall act as a general release of all liens mentioned herein. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the urgent need to release the special assessments owed to the City prior to September 13, 1950, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolu- tions at three regular meetings so that this resolution is passed and shall take effect upon first reading as an emergency measure this 7 day of September, 1981. -1474.44, i -J41 ATTEST: Secretary ry APPROVED: / DAY OF SEPTEMBER, 81 J.
