TUREGANO FOR A SCULPTURE PIECE CALLED "SEA BIRD" AS MORE FULLY SPECIFIED IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with Fernando A. Turegano for a sculpture piece called "Sea Bird" as more fully specified in the contract; a substantial copy of which is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the contract so that Mr. Turegano may begin on the sculpture as soon as possible, such finding of an emergency is made and declared requir- ing suspension of the Charter rule as to consideration and voting upon ordin- ances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this 7 day -of ac. b9•1, 1981. Scope of the work. Sculptor will create a sculpture entitled "Sea Bird" utilizing the image and design exhibited on the scale model show- ing a bird and the sea. The sculpture piece will stand approximately sixteen feet tall and cover an area of seven feet by ten feet. The bird will be made of copper. and the sea of welded steel. The copper will have a patina while the steel will be sandblasted with d three coat system of Dimetocet, • Amercoat epoxy and Amercoat poluyurethane. Both the patina and the coatings Are to be approved by the Engineering Department prior to their application.. The.sculptgre will stand in themiddle.of the -area' appropriated so that it will be seen in the round. 2. Location of work. The sculpture will be located on the Bayfront Plaza at the far East on the main plaza. A marked site plan is attached as Exhibit A. . At the location the sculpture piece will be anchored into the floor in conformity with directions from the Department of Engineering. 3. Liability to and from work. Sculptor hereby assumes all liability for any damage he may do or cause as a result of his work. Sculp- tor also assumes all responsibility for any damage' that may be done to his work by others while under construction and agrees to.hold the City harmless .therefrom. 4., Time for construction. The construction of the sculpture shall begin as soon as possible no later than_six calendar months from the date of this agreement. Construction to be completed within eight (8) months of start. .S Inspection and approval. The work will be submitted to the city council for their inspection and approval upon its completion. 6. Payment. The City shall pay the Sculptor the sum of Twenty Thousand Dollars and no cents ($20,000.00) which shall include all costs, including the Sculptor's fee, cost of materials, base, installation, trans- portation, and any other incidental costs. Payment for materials, supplies, transportation, and other specific costs will be paid as invoiced up to 75 percent of the contract amount.
