HomeMy WebLinkAbout16594 ORD - 10/14/1981sp;10/12/81;lst AN ORDINANCE APPROVING ADOPTION OF A STANDARD FORM BLANKET AGREE- MENT BETWEEN THE CITY OF CORPUS CHRISTI AND THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE INSTALLATION, OPERATION, AND MAINTENANCE OF TRAF- FIC SIGNALS TO BE INSTALLED AT VARIOUS LOCATIONS IN THE CITY OF CORPUS CHRISTI, FINANCED THROUGH FEDERAL - AID SAFETY FUNDS, DESIGNATED AS "MUNICIPAL AGREEMENT (TRAFFIC SIGNAL SAFETY FUNDS, TYPE B)", IN SUBSTAN- TIALLY THE FORM ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Approval is hereby given for adoption of a standard form blanket agreement between the City of Corpus Christi and the State Department of Highways and Public Transportation for the installation, oper- ation and maintenance of traffic signals to be installed at various loca- taions in the City of Corpus Christi, financed through federal -aid safety funds, designated as "MUNICIPAL AGREEMENT (TRAFFIC SIGNAL - SAFETY FUNDS, TYPE B)", in substantially the form attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of adopting a standard form of agreement for installation, operation, and main- tenance of traffic signals to be installed within the city limits, thereby eliminating the necessity for separate ordinances for installation of each traffic signal and to expedite the installation of said traffic signals, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolu- tions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency this / 9 day of October, 1981. WITNESSETH WHEREAS, the City has authorized the installation of highway traffic signal(s) by Ordinance/Resolution, passed on the day of ,-19 , at the location(s) shown on EXHIBIT 1, attached hereto and made a part hereof; AGREEMENT NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows: 1. The State will provide for the actual construction, pre- pare plans and specifications, install said highway traffic signal(s) and supervise construction. The City hereby consents to the construction of the high- way traffic signal(s) shown on EXHIBIT 1 by the approval of the location and manner of construction as shown on the plans and described in the specifications. 3. The City will operate and maintain the highway traffic signal(s) in a manner consistent with the design upon completion of the installation(s) by the State. 4. The City will pay all power costs for operating the signal(s). 5. The; City will be responsible for the police enforcement required for securing obedience to the highway traffic signal(s). 6. In the event the terms of this Agreement are in conflict with the provisions of any other existing agreements and/or contracts between the City and the State, this Agreement shall take precedence over the other agreements and/or contracts. 7. This Agreement shall apply to all highway traffic signal installations approved by both the State and the City, the City's approval being indicated by signature of the City Manager on the --plan title sheet for such installation. Highway traffic signal installations made a part of this Agreement shall contain on the title sheet the following statement: The City hereby consents to the construction of this Highway Traffic Signal as to location and manner of coistruction as indicated on these plans, said installation being a part of "Agreement (Traffic Signal - Safety Funds, Type B) dated AGREEMENT (TRAFFIC SIGNAL - SAFETY FUNDS, TYPE B) 6-81-16 2-4 IN TESTIMONY WHEREOF, the parties hereto have caused these presents to be executed in triplicate on the dates shown hereinbelow.
