HomeMy WebLinkAbout16598 RES - 10/14/1981sp;10/12/81;1st A RESOLUTION REAFFIRMING THE CITY OF CORPUS CHRISTI'S LEGISLATIVE POSITION OPPOSING ANY PROPOSED LEGISLATION PROHIBI- TING HOME RULE CITIES FROM ANNEXING BEYOND ONE MILE FROM THE GULF SHORELINE AND OPPOSING ANY PROPOSED LEGISLATION DEANNEXING ANY PORTION OF ANY HOME RULE CITY; AND DECLARING AN EMERGENCY. WHEREAS, House Bill 411 and Senate Bill 100 introduced in the 1981 Texas Legislature proposed to prohibit annexation by home rule cities more than one mile seaward of the shoreline of the Gulf of Mexico, and pro- posed to deannex any existing portions of home rule cities which extended beyond one mile from the Gulf shoreline; and WHEREAS, the City Council found such proposed legislation to be contrary to the public interest and adopted a legislative position opposing such legislation; and WHEREAS, the 1981 Texas Legislature did adopt an amended version of House Bill 411 which prohibits any future annexation by any home rule city of any State submerged lands Gulfward from the shoreline until October 1, 1983; and WHEREAS, the ban on future annexations includes areas more than one mile from the corporate city boundaries in bays and estuaries such as Corpus Christi Bay, Nueces Bay, Cayo del Oso, and Laguna Madre; and WHEREAS, the Texas Senate also passed S. R. No. 719 instructing the Senate Committee on Natural Resources to conduct an interim study of the conflict of interest between coastal home rule cities and offshore oil interests regarding the issue of annexation; and WHEREAS, the Texas House of Representatives Committee on Energy Resources has been charged to study requirements for the municipal annexa- tion of submerged lands to determine if any changes are necessary; and WHEREAS, the Chairman of the Senate Committee on Natural Resources has requested that the City of Corpus Christi provide testimony at the October 30, 1981, meeting of the Senate Natural Resources Committee in Galveston on the direct fiscal impact to Corpus Christi from offshore annexa- tion and has advised that the offshore oil interests will also be contribu- ting information to the committee on this issue; 1(3598 SEP 2 71984 MICROFILMED NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City of Corpus Christi's legislative position opposing any proposed legislation prohibiting home rule cities from annex- ing beyond one mile from the Gulf shoreline is reaffirmed. SECTION 2. That the City of Corpus Christi's legislative position opposing any proposed legislation deannexing any portion of any home rule city is reaffirmed. SECTION 3. That the City Council finds that any proposed legis- lation which would establish any new or additional limitations or restric- tions on home rule cities as to the annexation of bays and estuaries or as to the exercise of municipal government authority in bays and estuaries would be contrary to the public interest, and hereby adopts the City of Corpus Christi's legislative position opposing any such proposal. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of reaffirming the City of Corpus Christi's legislative position of opposing the aforesaid proposed legislation prior to the October 30, 1981, meeting of the Senate Natural Resources Committee, such finding of an emergency is made and declared requiring suspension of the Charter rule as to considera- tion and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency this ATTEST: day of October, 1981. a�M&ity etre ary APPROVED: /a DAY OF OCTOBER, 1981 .
