Home My WebLink About16604 ORD - 10/14/1981lst;10/14/81;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEI, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF HAROLD KRONKE, BY AMENDING THE ZONING MAP BY CHANG- ING THE ZONING OF LOT 13-B, BLOCK 3, HIGHWAY VILLAGE NO. 1, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT WITH "SP" TO "B-4" GENERAL BUSINESS DISTRICT WITH "SP" ON THE NORTH 90 FEET OF THE AFORESAID LOT 13-B, BLOCK 3, HIGHWAY VILLAGE NO. 1, FOR THE OPERATION OF AN ELEC- TRICAL SHOP AS MORE FULLY DESCRIBED ON THE SITE PLAN, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF AND SUBJECT TO THE CONDITIONS SET FORTH HEREIN- AFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Harold Kronke for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear -and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, October 7, 1981, at Regular Council Meeting of the City Cduncil in the Council Chamber at City Hall i•n the City of Corpus Christi; and __ WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus CHristi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by 'Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of Lot 13-B, Block 3, Highway Village No. 1, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "R -1B" One Family Dwelling District with "SP" to "B-4" General Business District with Special Council Permit on the north 90 feet of the aforesaid Lot 13-B, Block 3, Highway Village No. 1, for the operation of an electrical shop, said 90 -foot portion being more fully described hereinafter, and as more particularly described on the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit Being a tract or parcel containing 0.175 acres of land, more or less out of Lot 13-B, Block 3, Highway Village Section 1, as shown by plat recorded in Nueces County Map Records, Volume 46, page 20 and further described by metes and bounds as follows: Beginning at a point, the northwest corner of said Lot 13-B for the northwest corner of this tract; Thence east along the north boundary of said Lot 13-B, a distance of 84.70 feet more or less to a point on the east boundary line of aforementioned Lot 13-B, for the northeast corner of Lot 134 and the northeast corner of this tract; Thence south along the east boundary line of said Lot 13-B, a dis- tance of 90.00 feet more or less to a point for the southeast corner of this tract; Thence west a distance of 84.70 feet more or less to a point on the west boundary line of said Lot 13-B for the southwest corner of this tract; Thence north along the west boundary line of said Lot 13-B, a distance of 90.00 feet more or less to the point of beginning. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas,approved onthe 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs, by approving change of zoning and by granting a special permit for an electrical shop, as aforesaid, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of r,�,G,�,h, tJ , 1981.
