HomeMy WebLinkAbout16607 ORD - 10/14/1981sp;10/13/81;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF PJC PARTNERSHIP AMENDING THE.ZONING MAP BY CHANGING THE ZONING ON A PORTTON OUT OF I OT 17. SFC TTON 11, FI NIR BLUFF AND ENCINAL FARM AND GARDFN TRACTS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1R" ONF FAMTI Y OWFI 1 TNG nTSTR1fT TO"R-4" GFNFRAI RIISTNFSS OTSTRTrT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE ORDINANCESSINNG CONFLItCTNCE AS HEREWITH; AND;DECLARINIG ALL AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of PJC Partnership for -amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to -appear and be heard were heard, to consider the same before_the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday October 14, 1981 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and . WHEREAS, by motion duly by the City Council that to approve ublic health, necessity best serve p of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter made, seconded and carried, it was -decided the hereinafter set -forth amendment woul d and convenience and the general welfare set out. That the hereinafter described tract or parcel of land, described as a portion of Lot 17, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus christi, Nueces County, Texas, be and the same is hereby rezoned from "R -1B" One -family Dwelling District to "B-4" General Business District: FIELDNOTES for proposed B-4 zoning of approximately 2.20 acres of land out of Lot 17, Section 13, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume "A", Pages 41, 42 and 43, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest right -of -Way Iine of Williams Drive (120.00 feet wide), same being the Southwest right-of-way line of a City of Corpus Christi 40.00 foot wide underground drainage easement for the North corner of Lot 3, Block 9, Gulfway-Airline Park Unit -1, a map of which is recorded in -Volume 44, Page 142 of said map records and the East corner of this tract; • THENCE South 29°00'00" West, along the common boundary Iine of said Lot 17, Section 13 and said Lot 3, Block 9, 160.00 feet for the West corner of said Lot 3, Block 9 and the South corner of this tract; THENCE North 61°01'00" West 600.09 feet to a point on the Southeast right- of-way line of South Staples Street for the West corner of this tract; THENCE North 29°00'00" East, along said Southeast right -of -wag, parallel to the centerline_of South Staples Street thereof and 60.00 feet distant there- from, measured at right angles thereto, 160_00 feet for the North corner of this tract; THENCE South 61°01'00" East, along the aforementioned Southwest right-of-way line of Williams Drive, parallel to the centerline of said Williams Drive thereof and 60.00 feet distant therefrom, measured at right angles thereto, 600.09 feet for the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same•is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity for immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such -2- ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared that such public necessity exists, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the / day of , 1981.
