HomeMy WebLinkAbout16610 ORD - 10/21/1981• sp;10/19/81;1s1: AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, AS AMENDED, BY ADDING A NEW SECTION, TO BE NUMBERED 55-74, TO PROVIDE FOR SETTING A FEE TO BE PAID THE CITY BY OWNERS OR DEVELOPERS USING OR UTILIZING THE CIMMARON BOULEVARD SANITARY SEWER SYSTEM SOUTH OF SARATOGA BOULEVARD TO THE OSO CREEK WITHIN THE BOUNDARIES AS SHOWN ON THE ATTACHED EXHIBIT "A", COMPRISING APPROXIMATELY 1700 ACRES; PROVIDING FOR A USE FEE OF $800 PER ACRE OR $200 PER LOT; PRO- VIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Corpus Christi, City Code as amended, be amended by adding a new section, to be numbered Section 55-74 to hereafter read as follows: "Section 55-74. Cimmaron Boulevard Sanitary Sewer Service area Service Fee. '(a) As City sanitary sewer service is available at the inter- section of Saratoga Boulevard and Cimmaron Boulevard to serve the area south of Saratoga Boulevard southerly to Oso Creek per the City's Master Plan for Sanitary Sewer Service for the area, and the extension from said intersection southerly of such sanitary sewer system has begun, it has been determined that a use fee will be charged by the City for all such owners and/or developers of such lands south of Saratoga Boulevard desiring to use such system. The attached Exhibit 'A' to this ordinance indicates the service area for such sanitary sewer trunk system and/or the areas so de- signed to be provided sewer service by the Cimmaron trunk sanitary sewer system, and comprises approximatly 1700 acres. '(b) A fee of $800 per acre or $200 per lot, whichever is larg- er, will be paid the City for all properties and lands included in the service area for the Cimmaron Boulevard sanitary sewer system as shown on the attached Exhibit 'A'; except, however, that Developers of properties within such service area may be reimbursed for larger and/or deeper lines than required for such properties when such larger or deeper lines are in- stalled in accordance with the Master Plan for Sanitary Sewers for the SEPIInt MICROFILMED service area referenced herein. The City will require such fee to be paid prior to the final plat for such lands being signed by the Director of Engineering and Physical Development prior to being filed for record in the County records. In the event some of the lands in the service area shown on Exhibit 'A' are platted, said fee as outlined above will be paid the City prior to the owners or developers of such lands utilizing the Cimmaron Boulevard sanitary sewer system, regardless of land use proposed for the areas. '(c) Fees received by the City under this ordinance will be placed in a fund for the sole purpose of utilizing such monies in the fund as a source to construct additional sanitary sewer facilities in the service area shown on attached Exhibit 'A'. Funds received from the service area referenced herein will be utilized in the service area to construct addi- tional sanitary sewer facilities so as to develop the service area with this utility. All fees will be indexed to the Engineering News Record and adjusted to September 1 each year. '(d) This Section 55-74 shall remain in full force and effect until such time as the City Council adopts a city-wide policy relative to sanitary sewer service area charges by an appropriate amendment to the City's platting ordinance, at which time this section shall become null and void." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. • GAYO DEL- OSO, ••••116 CITV 1 1� •eco% / 320o _- That the foregoing ordinance was read for second reading on this the a3 day o following vote: Luther Jones Betty N.
