HomeMy WebLinkAbout16631 ORD - 10/28/1981lt;10/26/81;lst d AN ORDINANCE CLOSING AND ABANDONING, SUBJECT TO REPLATTING AT THE OWNER'S EXPENSE, THAT PORTION OF A 10 -FOOT UTILITY EASEMENT IN LOT 9, BLOCK 6-5 AND THAT PORTION OF ADJACENT 5 -FOOT UTILITY EASEMENT IN LOT 10, BLOCK B-4, PORT AYERS SUBURBAN CENTER, AS MORE FULLY DE- SCRIBED HEREINAFTER; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot utility easement in Lot 9, Block B-5,Port Ayers Suburban Center, adjacent to the south boundary line of said Lot 9, as recorded in Volume 45, pages 91 and 92, and a 5 -foot utility easement adjacent to the north boundary line of Lot 10, Block 6-4, Port Ayers Suburban Center, a map of which is recorded in Volume 43, page 59, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easements, subject to replatting of the properties at the owner's expense: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described 15 -foot wide utility easement, being 10 feet adjacent to the south boundary line of Lot 9, Block B-5, Port Ayers Suburban Center, a map of which is recorded in Volume 45, pages 91 and 92, and 5 feet adjacent to the north boundary line of Lot 10 Block B-4, Port Ayers Suburban Center, a map of which is recorded in Volume 43, page 59, Map Records of Nueces County, Texas, and described as follows: BEGINNING at a point on the West right-of-way line of South Port Avenue same being the East boundary line of said Lot 10, Block B-4 for the Southeast corner of said existing 5.00 foot wide utility easement and the Southeast corner of this description from which corner the Northeast corner of said Lot 10, Block B-4, same being the Southeast corner of said Lot 9, Block B-'5 bears with said right-of-way, North 00°56`10" West 5.00 feet; THENCE South 89°03'50" West, along the South boundary line of said 5.00 foot wide utility easement, parallel with the common boun- dary line of said Lot 10, Block B-4 and Lot 9, Block B-5, 358.79 feet for a corner of said existing 5.00 foot utility easement and a corner of this description; THENCE North 61°38'20" West, with the continuation of said 5.00 foot utility easement, 111.23 feet to a point on the East boundary line of a 10.00 foot wide utility easement recorded in Volume 1725, Pages 996, 997, 998, 999, Deed Records of Nueces County, Texas, for the Southwest corner of this description; lutiulUFILMER 16631 SEP 2 71984 THENCE North 27°29'50" East, along the aforementioned East boun- dary line, at 5.00 feet pass a point on the common boundary line of said Lot 10, Block 13-4 and Lot 9, Block 13-5 for the Northeast corner of said 10.00 foot wide utility easement recorded in Volume 1725, in all a distance of 15.00 feet for the Northwest cor,lar of this descrip- tion; THENCE South 61°38'20" East, along the North boundary line of said existing 10.00 foot wide utility easement out of said Lot 9, Block B-5, 107.54 feet for a corner of said 10.00 foot wide utility easement and a corner of this description; THENCE North 89°03'50" East, with the continuation of said 10.00 foot utility easement, 354.87 feet to a point on said West right-of-way,line of South Port Avenue, same being the East boun- dary line of said Lot 9, Block B-5 for the Northeast corner of said existing 10.00 foot wide utility easement and the Northeast corner of this description; THENCE South 00°56'10" East, along said right-of-way line of South Port Avenue, at 10.00 feet pass the common front corner of Lot 9, Block B-5 and Lot 10, Block B-4, in all a distance of -15.00 feet to the PLACE OF BEGINNING, be and the same is hereby closed for public use and every municipal purpose, subject to replatting of the properties at the owner's expense. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall net affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by the closing of the hereinabove described easement and abandonment of the same to the abutting property owners, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect,,upo��� n �first reading as an emergency measure this the ..4day ofiC//J(is.�/ , 1981.
