HomeMy WebLinkAbout16639 ORD - 11/04/1981sp;10/19/81;1st s AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH JOE FRENCH AND MARTHA ELLISON PERTAINING TO THE DEVELOPMENT OF A 32.89 ACRE TRACT OF LAND PROPOSED TO BE KNOWN AS CAJI INDUSTRIAL SUBDIVISION; PROVIDING FOR DEVELOPERS CHANGING OUT IMPELLERS IN A CITY LIFT STATION, UTILIZING CITY LIFT STATION; PROVIDING FOR PAYING THE CITY $800 AN ACRE TO BE DEPOSITED IN THE SANITARY SEWER FUND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Joe French and Martha Ellison pertaining to the development of a 32.89 acre tract of land proposed to be known as Caji Industrial Subdivision. SECTION 2. That the aforesaid developers will be permitted to connect to the City's lift station providing that the developers replace pump impellers for both pumps in the lift station and to increase wet well capacity of the lift station. SECTION 3. That the developers will pay the City $800 an acre to be deposited in the Sanitary Sewer Fund payable before the plat of the aforesaid tract is filed for record, all as more fully set out in the agree- ment, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". 16639 WOWED sEp '4,119$4 AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES X This agreement is entered into between the City of Corpus Christi, Texas, hereinafter called "CITY", and French -Ellison, a general partnership, hereinafter referred to as "DEVELOPERS", and pertains to the platting and development of a 32.89 acre tract of land at the northwest corner of Bear -Lane and South Padre Island Drive (see Exhibit "A") proposed to be known as the CAJI INDUSTRIAL DEVELOPMENT. WHEREAS, DEVELOPERS propose to develop the 32.89 acre site and desire to connect to the CITY sanitary sewer system, and WHEREAS, the nearest gravity sanitary sewer designed to serve the area per the CITY Master Plan for Sanitary Sewers is located at Flato Road and Bear Lane, and WHEREAS, DEVELOPERS have requested CITY permission to connect to a recently constructed sanitary sewer lift station immediately south of said 32.89 acre site at Bear Lane as shown on the attached Exhibit "A". NOW, THEREFORE, CITY and DEVELOPERS agree as follows: 1. CITY will permit DEVELOPERS to connect to said lift station providing DEVELOPERS agree to provide replacement pump impellers for both pumps in the lift station and to increase wet well capacity of the lift station. The CITY will specify both impeller and wet well modifications. 2. DEVELOPERS may construct a sanitary sewer collection system on the 32.89 acre tract in accordance with CITY codes and/or requirements pertaining to same to include utility tap requests. 3. All other requirements of the CITY's Platting Ordinance will be complied with by DEVELOPERS pertaining to the platting of the 32.89 acre tract. 4. DEVELOPERS will deposit with the CITY's Director of Engineering and Physical Development the sum of $800.00 per acre for the 32.89 acres or a total of $26,312.00. Said sum is to be paid the CITY before the plat of the 32.89 acre tract is filed for record in County records. 5.
