HomeMy WebLinkAbout16684 ORD - 11/11/1981- lt:11/1l/81;lst r + ' AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE CURRENT CONTRACT BETWEEN THE CITY AND THE NUECES COUNTY RURAL' FIRE PREVENTION DISTRICT NO. 2 (FLOUR BLUFF), AUTHORIZED BY ORDINANCE NO. 16538, PASSED AND APPROVED BY THE CITY COUNCIL ON SEPTEMBER 16, 1981, BY PROVIDING FOR WORKERS' COMPENSATION INSURANCE COVERAGE BY THE CITY UNDER THE TERMS OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY AND THE TEXAS MUNICIPAL LEAGUE WORKERS' COMPENSA- TION JOINT INSURANCE FUND, A COPY OF SAID AMENDMENT BEING ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the current contract between the City and the Nueces County Rural Fire Prevention District No. 2 (Flour Bluff), authorized by Ordinance No. 16538, passed and approved by the City Council on September 16, 1981, so as to provide for workers' compensation insurance coverage by the City under the terms of an interlocal agreement between the City and the Texas Municipal League Workers's Compensation Joint Insurance Fund, a sub- stantial copy of said amendment being attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs and amendment of the aforesaid con- tract in order to provide for workers' compensation insurance coverage under the existing agreement between the City and the Texas Municipal League Workers' Compensation Joint Insurance Fund, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the // day of November, 1981. BR CE AYCOCK, CITY TTORNEY MAYOR THE CITY OF CORPUS CHRISTI, TEXAS 1668,1 ILGR JLMED iSEP 27 1984 AMENDMENT TO CONTRACT THE STATE OF TEXAS COUNTY OF NUECES ➢ WHEREAS, by authority of Ordinance No. 16538, passed and approved by the City Council on September 16, 1981, the City of Corpus Christi and the Nueces County Rural Fire Prevention District Number Two executed a contract, effective from September 1, 1981 through August 31, 1982, for the purpose of providing a more effective firefighting force in that portion of the City of Corpus Christi known as the Flour Bluff area and to provide for con- tinued omission of the ad valorem tax previously levied by the said Nueces County Rural Fire Prevention District Number Two; and WHEREAS, .it—is the desire of the parties to the said contract to amend certain provisions thereof in order for the City to provide for workers' compensation insurance coverage: NOW, THEREFORE, the contract heretofore entered into by and between the City and District be amended as follows by amending paragraph VI: 1. That the first sentence be deleted, and in lieu thereof, that the following provisions be substituted therefor: "As additional consideration for this contract, City agrees to provide Workers' Compensation insurance coverage for the Nueces County Rural Fire Prevention District No. 2 volunteer firefighters under the terms of and by virtue of an interlocal agreement between the City and the Texas Municipal League Workers' Compensation Joint Insurance Fund, a substantial copy of which insurance contract supplement is attached hereto and made a part hereof." Except as hereby and herein amended, the terms and conditions of the aforesaid contract shall remain in full force and effect. EXECUTED IN DUPLICATE originals this day of 1981. BRUCE AYCOCK, CITY ATTORNEY By Assistant City Attorney NUECES COUNTY RURAL FIRE PREVENTION DISTRICT NUMBER TWO ATTEST: 13y SUPPLEMENT TO INTERLOCAL AGREEMENT TML WORKERS' COMPENSATION JOINT INSURANCE FUND In consideration of the Employer Members' request for payment of additional benefits and in further consid- eration of the Fund's agreement to pay such benefits, the Interlocal Agreement is amended by adding thereto the applicable coverages: Volunteer Firemen and Police Reserves—The Fund will pay on behalf of the Employer Member, If an em- ployee within a public safety officer group of employees hereinafter described, shall sustain injury, including death resulting therefrom, under circumstances which would have rendered the Employer Member liable for compensation if the injured employee and the Employer Member had been subject to the Texas Workers' Com- pensation Law with respect to such employment, an amount equal to the compensation and other benefits which would have been payable under such law had the injured employee and the Employer Member been sub- ject to such law with respect to such employment. The parties of this agreement do not by Its use intend to make applicable to themselves any provision of the Texas Workers' Compensation Law not already In force and effect as to them. The reference to the Texas Workers' Compensation Law is intended as a measure and extent of benefits and the liability therefore and not an adoption of the law. Elected Officials—If a resolution of the governing body has been adopted providing coverage for elected officials as required by law, such elected officials while acting within the course and scope of their official duties, shall be covered by the Interlocal Agreement as any other employee of the political subdivision. The Employer Member agrees to pay the premium for the payroll classifications checked below.
