AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT
PROVIDING FOR THE SCHOOL DISTRICT REIMBURSING THE
CITY FOR 100 PERCENT OF THE COST OF A PARKING LOT AT
THE CARROLL LANE ELEMENTARY SCHOOL ABUTTING CARROLL
LANE, SAID PARKING LOT TO BE CONSTRUCTED CONCURRENT-
LY WITH THE CARROLL LANE STREET IMPROVEMENTS, A SUB-
STANTIAL COPY OF WHICH AGREEMENT IS ATTACHED HERETO
AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with the Corpus Christi Independent School District
providing for the school district reimbursing the City for 100 percent of
the cost of a parking lot at the Carroll Lane Elementary School abutting
Carroll Lane, said parking lot to be constructed concurrently with the
Carroll Lane street improvements, a substantial copy of which agreement is
attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
executing the aforesaid agreement so that the Carroll Lane street improvements
can proceed on a timely basis, such finding of an emergency is made and declar-
ed requiring suspension of the Charter rule as to consideration and voting up-
on ordinances or resolutions at three regular meetings so that this ordinance
is passed and shall take effect upon first reading as an emergency measure

This agreement is authorized by Ordinance No. and is entered into
between the City of Corpus Christi, Texas (Party of the First Part), hereinafter
called "CITY", acting through its Acting City Manager, and the Corpus Christi Inde-
pendent School District (Party of the Second Part), hereinafter called "DISTRICT",
acting through its Superintendent.
WHEREAS, the "CITY" in conjunction with the Texas Department of Highways
and Public Transportation has caused plans to be prepared for the improvement of
Carroll Lane from Staples Street to Gollihar Road, and
WHEREAS, the "DISTRICT", being owners of the Carroll Lane Elementary School
(situated on a portion of Lot 2, Section B, Paisley's Subdivision of the Hoffman
Tract, as shown by map of record in Volume A, Page 28, Map Records, Nueces County,
Texas, and adjacent to Carroll Lane), desire to make certain improvements to the
parking lot at said school concurrently with the improvements to Carroll Lane;
NOW, THEREFORE, the CITY and DISTRICT agree as follows:
1. The CITY will include the improvements to the DISTRICT'S parking lot
in the Construction Contract for the improvements to Carroll Lane. The parking lot
improvements are as shown on Exhibit "A" attached hereto and made a part hereof.
All work shall be done in accordance with the plans and specifications for the project
as prepared by the.Texas Department of Highways and Public Transportation.
2. The DISTRICT shall reimburse the CITY the actual cost of construction
of the aforesaid improvements to the parking lot. The estimated cost of construction,
based upon the Texas Department of Highways and Public Transportation estimate, is as
shown on Exhibit "B" attached hereto and made a part hereof. This estimate is
included for informational purposes only and the final cost of said improvements
shall be based on actual contract unit bid prices.
3. Upon completion of the entire project and after formal acceptance of
same by the City and State, the DISTRICT will pay the CITY, upon proper invoicing,
the cost of the parking lot improvements within thirty (30) days of the invoice date.
4. This agreement shall in no way affect the CITY'S assessing the DISTRICT
for their proportionate share of the cost of the improvements to Carroll Lane as
specified by City Ordinance.
5. The Agreement shall become effective and shall be binding upon and
shall inure to the benefit of the parties hereto and their respective heirs, successors
and assigns from and after the date of execution.
