AN ORDINANCE
•
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
PADRE STAPLES MALL BY
AMENDING THE ZONING MAP BY CHANGING THE ZONING ON
LOTS 1, 2, 6 AND 9, BLOCK 9; AND LOTS 5, 7 AND 8,
BLOCK 10, MUUNI VEKNUN NU. 6
SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY,
TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT
TO "B-4" GENERAL BUSINESS DISTRICT
; KEEPING IN EFFECT ALL OTHER PROVISIONS
OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of
Padre Staples Mall for amendment to the zoning map of
the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on
March 11, 1981
Wednesday
, at Special Council Meeting of the
City Council in the Council Chamber at City Hall in the City of Corpus Christi;
and
WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed on the 27th day of August, 1937, appearing of record
in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as
amended from time to time, and in particular as amended by Ordinance No. 6106,
as amended, be and the same is hereby amended by making the change hereinafter
set out.

SECTION 2. That the zoning of Lots 1, 2, 6 and 9, Block 9, and
Lots 5, 7 and 8, Block 10, Mount Vernon No. 3, situated in the City of Corpus
Christi, Nueces County, Texas, be and the same is hereby changed from "R -1B"
One Family Dwelling District to "B-4" General Business District.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended
from time to time, except as herein changed, shall remain in full force and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its introduc-
tion and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared that such emergency

and necessity exist, having requested the suspension of the Charter rule
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effectt�from and after its passage,

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.

In connection with the above -referenced applications for
zoning change, the undersigned owners of the subject property

business purposes under B-4 zoning until the lots have been
replatted and provision made for street closings.

Re: Zoning Change from R1 -B to B-4, on Lots 12 thru 22,
Block 10, all of Block 11, and North half of Mount
Vernon Drive adjacent to Lot 11, Block 11, Mount
Vernon Subdivision #l3
The writer, representing Padre Staples Mall, made application for the
referenced zoning change, said request was duly heard before the Zoning
and Planning Commission and forwarded approved for hearing before the City
Council. On August 13, 1980, a public hearing was held on the application
of the Padre Staples Mall to change the zoning on the referenced property.
A motion was passed to approve the application subject to replatting,
closing Janet Drive from Mt. Vernon to McArdle Street and closing Mt. Vernon
Drive East of Lenora Street. Inadvertently, an ordinance was passed approving
the zoning change. Since zoning cannot be made conditional, the City
Council repealed this ordinance at its meeting of November 12, 1980.
On February 11, 1981 the City Council approved.a nine months extension
of their action rezoning the referenced properties to allow Padre Staples
Mall to meet all conditions of replatting, utility design drawing, drainage
design drawings, and traffic, parking and ingress -egress drawings.
All of the drawings required by the Council and Staff have been
prepared and furnished to the .appropriate City Departments.
I earnestly request, for Padre Staples Mall, that the required public
hearing for the street closings be placed on the City Council agenda at
the earliest possible date.

Our office has been advised by Mr. L. H. Wenger of the Planning and
Urban Development Department that the ordinance to change the zoning as
approved by the City Council for lots on Lenora Street owned by Padre Staples
Mall was never passed as the Staff understood all the above mentioned work
be accomplished prior to finalizing this additional zoning. I further
request this action be included as an agenda item at the appropriate
Council meeting.
