HomeMy WebLinkAbout16708 ORD - 11/18/1981"sp;11/16/81;lst AN ORDINANCE AMENDING ORDINANCE NO. 15867, PASSED AND APPROVED BY THE CITY COUNCIL ON NOVEMBER 5, 1980, SO AS TO EXTEND THE AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND THE CORPUS CHRISTI JUNIOR COLLEGE DISTRICT FOR COLLEC- TION SERVICES THROUGH AUGUST 31, 1982, AS MORE FULLY SET FORTH IN THE AMENDED AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. WHEREAS, on or about the 25th day of November, 1959, the City of Corpus Christi entered into an agreement with the Corpus Christi Junior College District by the terms of which the City agreed to collect taxes for said College District under certain terms and conditions for a period of three years; and WHEREAS, the City and Corpus Christi Junior College District have extended the terms of the aforesaid agreement from time to time and as last extended by Ordinance No. 15867; and WHEREAS, said parties have been carrying out the terms of said tax collection contract which by its own terms will expire unless extended by the parties thereto; and WHEREAS, the City and the Corpus Christi Junior College District have agreed to an extension and amendment of said tax collection contract: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY ___. OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the agreement with the Corpus Christi Junior College District for an extension and amendment for a term of eight months of the present tax collection contract between said Junior College District and the City, originally authorized by Ordinance No. 5593 and as last ex- tended by Ordinance No. 15867, a substantial copy of which amended agreement is attached hereto and made a part hereof, marked Exhibit "A", and his execution of such agreement is hereby ratified and confirmed. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by the extension of the collection portion of the agreement between the Junior College District and the City, .eS? 381984 ASIMLMED. 16708 such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed ando shall take effect upon first reading as an emergency measure this the 18 day of November, 1981. ATTEST: Cit Secretary APPROVED: i '7 --DAY OF NOVEMBER, 1981 JBruce Aycock, Cit J Attorney MAYOR THE CITY OF CORPUS CHRISTI, TEXAS AMENDED AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES WHEREAS, by agreement effective from and after November 25, 1959, and extended from time to time by agreement, the Corpus Christi Junior College District and the City of Corpus Christi entered into agreement for the City Tax Assessor -Collector to assess and collect taxes for the District; and WHEREAS, Senate Bill 621, enacted by the Legislature of the State of Texas, relating to ad valorem taxation of property, Subchapter A, Section 6.01, proivdes for the establishment of tax appraisal districts in each county; and WHEREAS, effective January 1, 1982, the Nueces County Appraisal District will be responsible for appraisals in Nueces County; and WHEREAS, the Junior College District and City have agreed to ex- tend and amend the term of the contract heretofore entered into so as to make the same effective through August 31, 1982, as to collection of taxes, subject to the right of either party to give notice as provided in said contracts to sooner terminate the same: NOW, THEREFORE, it is mutually agreed as follows: Effective from and after January 1, 1982, the City acting by and through its Tax Assessor -Collector, shall collect taxes for the District as provided by Article 2791 and Article 2792, Revised Civil Statutes of Texas, for a term of eight months, commencing on January 1, 1982, and ending August 31, 1982. The -terms and conditions of this agreement are identical to the terms of the agreement heretofore existing between the City and District, except that wherever the dates of December 1, 1971, December 1, 1974, December 1, 1977, and/or December 1, 1980, appear there shall be sub- stituted the term of eight months beginning January 1, 1982, and that Sec- tion VII of the 1959 agreement is further amended to read as follows: "The City will provide computer services which are necessary to carry out the functions of the office as determined by the Tax Assessor- 4"xis..g'‘ Collector and indicated to the Data Processing Division through an annual statement of estimated work requirements and a timetable agreeable to both units." Said contract is further amended wherever the words "Utility Office" and "IBM Machines Services" appear they shall hereafter read "Data Processing Division" and "Computer Services." Further all reference to assessing properties in the District by the City shall be deleted.
