HomeMy WebLinkAbout16715 ORD - 11/18/1981jkh:11-17-81;lst AN ORDINANCE CANCELLING AND RESCINDING ORDINANCE NO. 14312, PASSED AND APPROVED BY THE CITY COUNCIL ON MAY 10, 1978, WHICH AUTHORIZED AN ARCHITECTURAL CONTRACT WITH TURNER, ROME, BOULTINGHOUSE & ASSOCIATES, INC., ARCHITECTS, FOR ARCHI- TECTURAL SERVICES IN CONNECTION WITH THE DESIGN AND PREPARATION OF PLANS AND SPECIFICATIONS FOR CONSTRUCTION OF ADDITIONS TO THE CORPUS CHRISTI POLICE DEPARTMENT BUILDING, AND DECLARING NULL AND VOID THE TERMS, CONDI- TIONS AND APPROPRIATIONS ARISING OUT OF SAID ORDINANCE AND THE CONTRACT THEREBY APPROVED; REVERTING THE APPROPRI- ATION OF $38,000 MADE FROM THE NO. 266 POLICE BUILDING BOND FUND FOR PROJECT NO. 266-77-1, POLICE BUILDING IMPROVE- MENTS; AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance No. 14312, passed and approved on May 10, 1978, authorization was granted for execution of an architectural contract between the City of Corpus Christi and Turner, Rome, Boultinghouse & Associates, Inc., Architects, for architectural services in connection with the design and preparation of plans and specifications for construction of additions to the Police Department Building, and the necessary funds were appropriated for the contemplated architectural services; and WHEREAS, inasmuch as no architectural services have been undertaken to date and no funds expended therefor, it is the desire of the parties to the contract that said contract be cancelled and be declared null and void: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 14312, passed and approved by the City Council on May 10, 1978, which authorized an architectural contract with Turner, Rome, Boultinghouse & Associates, Inc., Architects, for architectural services in connection with the design and preparation of plans and specifi- cations for construction of additions to the Corpus Christi Police Department Building, be and the same is hereby cancelled and rescinded, and the terms, conditions and appropriations arising out of said ordinance and the contract thereby approved and subsequently executed are hereby declared null and void. SECTION 2. That the funds appropriated by Ordinance No. 14312, in the amount of $38,000, out of the No. 266 Police Building Bond Fund for Project No. 266-77-1, Police Building Improvements, are hereby reverted to the said No. 266 Bond Funds. 16715 WORMED ,£51) 6 1984 SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by cancellation of the ordinance and contract authorizing architectural services in connection with additions to the Police Department Building as aforesaid, such finding of an emergency is made and declared requiring suspension of the Charter rule as to considera- tion and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the it4 day of November, 1981.
