AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH I.W. HICKHAM, JR., CONCERNING DEFERRAL OF CON-
STRUCTION OF APPROXIMATELY 900 LINEAR FEET OF 24 -INCH
TO 48 -INCH DIAMETER STORM SEWER IN A 44.78 -ACRE TRACT
PROPOSED TO BE KNOWN AS ST. CLAIR INDUSTRIAL PARK,
AND PROVIDING FOR CONSTRUCTION AND MAINTENANCE OF A
DRAINAGE SWALE, THE AFORESAID AGREEMENT TO BE A COVE-
NANT RUNNING WITH THE LAND, A SUBSTANTIAL COPY OF WHICH
AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute an
agreement with I.W. Hickham, Jr., concerning deferral of construction of
approximately 900 linear feet of 24 -inch to 48 -inch diameter storm sewer
in a 44.78 -acre tract proposed to be known as St. Clair Industrial Park, and
providing for construction and maintenance of a drainage Swale, the afore-
said agreement to be a covenant running with the land, a substantial copy
of which agreement is attached hereto and made a part hereof, marked
Exhibit "A". -
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs and execution of the aforesaid
agreement at the earliest practicable date in order_that development of the
industrial park may be commenced, such finding of an emergency is made and
declared requiring suspension of the Charter rule as to consideration and
voting upon ordinances or resolutions at three regular meetings so that
this ordinance is passed and shall take effect upon first reading as an
emergency measure this the day of November, 1981.

DEFERRED IMPROVEMENT AGREEMENT
THE. STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES X
This CITY OF CORPUS CHRISTI DEFERRED IMPROVEMENT AGREEMENT ("Agreement")
is entered into by and between the City of Corpus Christi, Texas ("City") and
I. W. HICKHAM, JR., TRUSTEE ("Owner").
WITNESSETH
WHEREAS, by Platting Ordinance of the City any parcel of property within
its city limits must be platted prior to sale or construction thereon; and
WHEREAS, Owner desires to replat its property, and sell a portion thereof,
which property to be replatted is situated in Nueces County, Texas, and described
as follows, ("Replat"), to -wit:
A 44.779 Acre, more or less, Tract of Land out of Lots 2, 3, 8 and 9,
Block 2, J. C. RUSSELL FARM BLOCKS, recorded in Volume 28, Pages 58
and 59, Map Records, Nueces County, Texas, being more particularly
described by the attached Exhibit "A", made a part hereof for all
pertinent purposes. .
WHEREAS, Owner further desires to sell a parcel out of the Replat Pro-
perty referenced above, which property to be sold is described as follows,
("Sale Property"), to -wit:
A 3.662 Acre, more or less, Tract of Land being a portion of Lot 9,
Block 2, J. C. RUSSELL FARM BLOCKS, as shown by plat recorded in
Volume 28, Pages 58 and 59, Map Records, Nueces County, Texas, said
tract being more particularly described in the attached Exhibit "B",
made a part hereof for allpertinentpurposes.
WHEREAS, a condition to final approval of said replat required by the
City upon Owner, along with other requirements, is that an underground storm
sewer conduit be installed at the expense of Owner for drainage of the southerly .
portion of said Replat Property (See Exhibit "C"); and
WHEREAS, Owner has requested to be permitted to install a temporary
drainage system concurrently with the development of said 3.662 acre tract of
land.
NOW THEREFORE, for and in consideration of the sum of $10.00 in hand
paid, the receipt and sufficiency of which is hereby acknowledged, and in

the parties agree as follows:

The City shall approve the Preliminary Plat
', and shall further approve the Final Plat of

Owner consents to, and shall construct all items
required by the City as evidenced by the attached Preliminary Plat (Exhibit "C")
except as modified by Paragraph 3 hereunder.
3. Deferral of Storm Sewer Conduit: Owner shall, for purposes of
furnishing a drainage plan, construct a "Temporary Drainage Swale" as shown by
Exhibits "D" and "E", attached hereto and made a part hereof for all pertinent
purposes. Pilot ditch construction shall start at Bear Lane with a minimum
3 foot wide bottom ditch with such ditch being a minimum of 3 feet wide through
the limits of the 100 foot wide right of way shown on Exhibits "D" and "E".
4. Limitation on Deferral: Owner expressly and unequivocally
recognizes, acknowledges and agrees that upon an event of sale of or construction
on any or all of the remaining Replat Property (excluding the Sale Property
and Northwesterly segment designated Block 4 on Exhibit "C") then Owner shall
construct with due diligence and in good faith the storm sewer conduit refer-
enced above, and the Agreement shall be terminated.
5. Intention: It is the intention of the parties hereto to provide
for a temporary deferral of required improvements to the Replat Property as a
condition to Replat. However, it is acknowledged that such conduit will be
"necessary" for proper drainage upon further sale or construction on the
remaining Replat Property as designated by Paragraph 4 above.
6. Dedication: Owner shall dedicate or cause to be dedicated to City
the 100 foot wide drainage right of way shown on Exhibits "D" and "E" within
30 days of date of approval by City of this instrument and before any plat is
filed for record within the herein referenced 44.779 acre tract.
7. Maintenance: Owner agrees to maintain said temporary drainage
swale east of the 100 foot wide drainage right of way until such time as the
deferred storm sewer is installed.
8. Binding Effect: This Agreement shall be binding upon and inure
to t.1e benefit of the parties hereto and their respective heirs, executors,

administrators, legal representatives, successors and assigns. This Agreement
shall RUN WITH THE LAND and is not personal in nature. Furthermore, the
parties and their successors and assigns shall execute all documents necessary
to implement this Agreement.
