HomeMy WebLinkAbout16732 ORD - 11/25/1981AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT 1 FROM "F -R" FARM RURAL DISTRICT AND "R -1B" ONE FAMILY DWELLING DISTRICT TO "I-3" HEAVY INDUSTRIAL DISTRICT; CHANGING THE ZONING ON TRACT 2 FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT; CHANGING THE ZONING ON TRACT 3 FROM "F -R" FARM RURAL DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT; CHANGING THE ZONING ON TRACT 4 FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT CHANGING THE ZONING ON TRACT 5 FROM "F -R" FARM -RURAL DISTRICT TO "I-2" LIGHT- INDUSTRIAL DISTRICT; CHANGING ZONING ON TRACT 6 FROM "F -R" FARM RURAL DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT, ALL AS MORE FULLY DESCRIBED HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DE- CLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday April 29, 1981 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made; seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 16'732 SEP 2 81984 MIGROFJLMEO SECTION 2. That the hereinafter described tracts of land, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby rezoned as hereinafter stated: Tract 1 From "F -R" and "R -1B" to "I-3" All of those shares of land out of State Survey No. 404, Abstract No. 975, designated as Shares 1, 2, 3, and 4, Isensee Partition save and except the 10 northern most acres out of designated Share No. 1 for a total of 347.32 acres more or less. Tract 2 From "R -1B" to "I-2" An area of land containing 325.17 acres more or less out of Survey 406, Abstract 963, further described by metes and bounds as follows; BEGIINING at a point, the intersection of the East R.D.W. line of Rand Morgan Road and the North line of Survey 406, Abstract 963, the Southwest corner of a 5.0 acre tract now or formerly in the name of H.C. Davis for the Northwest corner of this tract; THENCE in an Easterly direction along said North line of Survey 406, said line also being the South boundary line of said 5 acre tract and the South boundary line of McNorton Subdivision, a distance of 3,433.35 feet more or less to the Northwest corner of a 4.83 acre tract now or formerly in the name of Southern Minerals Corporation for a corner of this tract; THENCE in a Southerly direction along the West boundary line of said 4.83 acre tract, a distance of 700 feet more or less to its Southwest corner for an inner corner of this tract; THENCE_in an Easterly direction along the South boundary line of said 4.83 acre tract, a distance of 300.6 feet more or less to a point on the West R.O.W. line of Clarkwood Road for the Northeast corner of this tract; THENCE in a Southerly direction along said West R.D.W. line of Clarkwood Road, a distance of 3,061.61'feet more or less to a point, the Northeast corner of a 117.6 acre tract nor or formerly in the name of Mary B. Humphries for the Southeast corner of this tract; THENCE in a Westerly direction along the North boundary line of said 117.6 acre tract, a distance of 3,733.95 feet more or less to a point on the East R.O.W. line of Rand Morgan Road for the Southwest corner of this tract; THENCE in a Northerly direction along the East R.O.W. line of Rand Morgan Road, a distance of 3,849.76 feet more or less to the POINT OF BEGINNING. Tract 3 From "F -R" to "1-2" All of Lots 22, 25, and 26 out of the H.B. Sheppard Farm Lots as shown on Plat of Record in Book A, Page 51, Nueces County Plat Records, Nueces County, Texas. Tract 4 Frain "R -1B" to "I-2" All of Blocks 8 and 9, Clarkwood Tract Subdivision as shown on Plat of Record in Volume 19, Pages 96 and 97, Nueces County Plat Records, Nueces County, Texas. Also, 46.618 acres of land more or less out of Lot 21, H.B. Sheppard Farm Lots as shown on Plat of Record in Book A, Page 51, Nueces County Plat Records, Nueces County, Texas and further described by metes and bounds as follows; BEGINNING at a point, the intersection of the South R.O.W. line of Sedwick Road and the East R.O.W. line of Clarkwood Road for the Northwest corner of this tract; THENCE in an Easterly direction along said South R.O.W. line of Sedwick Road, a distance of 1,273.26 feet more or less, to a point, the intersection of said R.O.W. line and the East boundary line of aforementioned Lot 21, for the Northeast corner of this tract; . THENCE in a Southerly direction, along the East boundary line of said Lot 21, a distance of 1,400 feet more or less, to a point, the Northeast corner of Block 9, Clarkwood Tract Subdivision for the Southeast corner of this tract; THENCE in a Westerly direction along the North boundary line of Blocks 8 and 9, Clarkwood Tract Subdivision, a distance of 666.64 more or less to a point on the East line of a 16.76 feet wide street dedication East of and adjacent to a 2.782 acre tract, nowor formerly in the name of L.C. Jackson, for the Southerly Southwest corner of this tract; THENCE in a Northerly direction along the East line of said 16.76 foot wide street dedication, a distance of 200 feet more or less to its Northeast corner, thereof, the same being the Southeast corner of a 2.782 acre tract of land, now or formerly in the name of C. A. Davidson for an inner corner of this tract; THENCE in a Westerly direction along a line common to the 2.782 acre Davidson Tract and the 2.782 acre Jackson Tract, a distance of 623.40 feet more or less, to a point on the East R.O.W. line of Clarkwood Road, for the Northerly Southwest corner of this tract; ^� THENCE in a Northerly direction along said East R.O.W. line of Clarkwood Road, a distance of 1,200 feet more or less to the POINT OF BEGINNING. Tract 5 From "F -R" to "I-2" All of Lots 13, 19, and 20 out of H. B. Sheppard Farm Lots as shown on Plat of Record, Book A, Page 51, Nueces County Plat Records, Nueces County, Texas and containing 246.9 acres more or less. Tract 6 From "F -R" to "I-2" A tract of land between Eleanor Tract Subdivision and Sedwick Road and East of and adjacent to Rhew Road in the City of Corpus Christi, Nueces County, Texas, now or formerly in the name of E. J. Hood and containing 117.921 acres more or less. BEGINNING at a point on a line common to Survey 586, Abstract A-1003 and Survey 591, Abstract A-1010, said point also being the Southeast corner of Tract 1, Eleanor Tract Subdivision as shown on Plat of Record in Volume 34, Page 36, Nueces County Plat Records, Nueces County, Texas for the Northeast corner of this tract; THENCE in a Southerly direction along the aforementioned common line between Survey 586, Abstract A-1003 and Survey 591, Abstract A-1010, a distance of 3,460 feet more or less, to a point on the North R.O.W. line of Sedwick Road for the Southeast corner of this tract; THENCE in a Westerly direction along said North R.O.W. line of Sedwick Road, a distance of 1,250 feet more or less to its intersection with. the East R.O.W. line of Rhew Road, for the Southwest corner of this tract; THENCE in a Northerly direction along the East R.O.W. line of Rhew Road, a distance of 4,100 feet more or less to its intersection with the Northwesterly extension of the South boundary line of the aforementioned Eleanor Tract Sub- division for the Northwest corner of this tract; - THENCE in a Southeasterly direction along said Northwesterly extension of the South boundary line of the Eleanor Tract Subdivision, at 204.8 feet more or less, pass the Southwest corner of Tract 7 of the aforementioned sub- division and continuing along said South boundary line of the Eleanor Tract Subdivision, a distance in all of 1,450 feet more or less to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity forimmediately making the aforesaid - change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor or Council members, having declared that such public necessity exists, having requested the suspension of the Charter rule and • that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an er its passage, IT IS ACCORDINGLY SO ORDAINED this the 25- day of , 1981.
