IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS:

(3)

• OF SAID HEARING AS REQUIRED BY THE LAWS OF THE STATE
-:: OF TEXAS AND THE CHARTER OF THE CITY OF CORPUS
CHRISTI; AND DECLARING AN EMERGENCY.
WHEREAS, heretofore, on the qth day of December 1981
the City Council by enactment of Ordinance No. 16739 determined that it
was necessary to improve the following by paving and sidewalks, as herein-
, after more fully described:
(1) Carroll Lane, from South Staples Street to Gollihar Road,
(2) Carroll Lane, from South Padre Island Drive to Tiger Lane,
and
(3) Mulberry Street, from Carroll Lane to Willow Street;
and
WHEREAS, by the terms of said ordinance, specifications were
ordered to be made by the Director of Engineering and Physical Development
for the improvement of the aforesaid street(s), within the limits defined,

submitted to the City Council for approval and adoption; and
WHEREAS, the City Council of.the City of Corpus Christi is of
ti:n opinion that it is necessary to levy an assessment against the property
and the owners thereof abutting upon the aforesaid .street(s), within the
limits defined, and against street and railway companies whose tracks occupy
said street, if any, for a part of the cost of improving said street(s),
fixing a time for the hearing of the owners of said property, and the said
railway companies, concerning the same, and directing the City Secretary to
give -notice of said hearing, as required by law; and
. WHEREAS, the City Council has heretofore, by ordinance, ordered
the improvement of the street(s) and portions enumerated above. Any exist-
ing curbs, gutters in place, meeting the specifications set by -the -City
Council, or which can be utilized, shall be left in place, if any, -and
corresponding credits to the property owners shall be allowed on the assess-
ments; and
WHEREAS, the Director of Engineering and Physical Development of
the City of Corpus Christi has, in accordance with the law, filed his
report with the City Council, setting forth the participation by the railway
companies and street railway companies, if any, and the property owners, in
the cost thereof, together with the names of the owners and the description
of said property, and the work to be done adjacent thereto, and the amount
to be assessed against each lot or parcel and its owner and all other matters
required by the applicable law:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the specifications so presented to the City Council
of the City of Corpus Christi by the Director of Engineering and Physical
Development and prepared by him for the improvements of the aforesaid street(s),
within the limits set forth, having been carefully considered by the City
Council, be, and the same are hereby, approved and adopted as the specifica-
tions for the improve::ents of said street(s) hereinabove enumerated, within
the limits defined.
SECTION 2.. The City Council, in initiating this proceeding, is
acting under the terms and provisions of the Act passed at the First Called
Session of the Fortieth Legislature of the State of Texas, and known as
Chapter 106 of the Acts of the said Session, together with any amendments
thereto, now shown as Article 1105b of Vernon's Texas Civil Statutes, as an
alternative method for the construction of street improvements in the City
of Corpus Christi, Texas.
SECTION 3. That the report or statement filed by the Director of
Engineering and Physical Development having been duly examined is hereby
approved.
SECTION 4. That there is hereby found and determined that the
cost of improvements on the hereinafter described street(s) with the
amount or amounts per front foot proposed to be assessed for such improve-
ments against abutting property and the owners thereof, and against street
and railway companies whose tracks occupy said streets, if any, are as
follows, to -wit:

PRELIMINARY ASSESSMENT ROLL
CARROLL LANE AND MULBERRY STREET
STREET IMPROVEMENTS
This project shall include improvements to the following streets:
(1) Carroll Lane, from South Staples Street to Gollihar Road,
(2) , Carroll Lane, from South Padre Island Drive to Tiger Lane, and
(3) Mulberry Street, from Carroll Lane to Willow Street.
These improvements shall provide for a roadway of 44' and 40' wide on Carroll Lane
and 28' wide on Mulberry Street within the existing right-of-way. Carroll Lane
will be constructed with a 6" stablized subgrade, a 11" flexible base and 11/4"
Asphaltic Concrete Pavement. Mulberry Street will be constructed with a 6" stabl-
ized subgrade, a 8" flexible base and 13" Asphaltic Concrete Pavement. All streets
will have standard curb and gutter sections, 4" thick reinforced concrete sidewalks
and 6" thick reinforced concrete driveways as shown on the plans.
This project is being constructed jointly by the City and the State Department of
Highways and Public Transportation and is an improvement assessment project. Based
on the low bid submitted by Asphalt Paving and Construction Company and the City's
current assessment policy, abutting property owners are assessed as follows:

IS
All assessments, however, are to be made and levied by the City
Council as it may deem just and equitable, having in view the special
benefits in enhanced value to be received by such parcels of property and
owners thereof, the equities of such owners, and the adjustment of the
apportionment of the cost of improvements so as to produce a substantial
equality of benefits received and burdens imposed.;;
SECTION 6. That a hearing shall be given to said owners of
abutting property, and of railways and of street railways, if any, or their
agents or attorneys, and all persons interested in said matter, as to the
amount to be assessed against each owner and his abutting property and
railways and street railways, and as to the benefits to said property by
reason of said improvement, or any other matter or thing in connection
therewith, which hearing shall be held in Carroll Lane Elementary School
Cafeteria, 4120 Carroll Lane, in the City of Corpus Christi, Nueces
County, Texas, on the 13th day of January , 19 82 , at 7:00
p.m., at which time all the said owners, their agents or attorneys or other
interested persons are notified to appear and be heard, and at said hearing
said owners and other persons may appear, by counsel or in person, and may
offer evidence, and said hearing shall be adjourned from day-to-day until
fully accomplished.
The City Secretary of the City of Corpus Christi is hereby directed
to give notice of the time and place of such hearing and of other matters and
facts in accordance with the terms and provisions of the Act passed at the
First Called Session of the Fortieth Legislature of the State of Texas, and
known as Chapter 106 of the Acts of said Session, together with any amendments
thereto, now shown as Article 1150b of Vernon's Texas Civil Statutues, which
said law, as an alternative method for the construction of street improvements
in the City of Corpus Christi, Texas, has been adopted by said City.
Said notice shall be by advertisement inserted at least three times
in a newspaper published in the City of Corpus Christi, Texas, the first
publication to be made at least twenty-one (21) days before the date of said
hearing. Said notice shall comply with and be in accordance with the terms
and provisions of the said Act.
The City Secretary is hereby further directed to give additional
written notice of the hearing by depositing in the United States mail, at

least fourteen (14) days before the date of the hearing, written notice of
such hearing, postage prepaid, in an envelope addressed to the owners of
the respective properties abutting such streets, highways, or portions of
streets or highways to be improved, as the names of such owners are shown
on the then current rendered tax rolls of the City of Corpus Christi, Texas,
and at the addresses so shown, or if the names of such respective owners do
not appear on such rendered tax rolls, then addressed to such owners as their
names are shown on the unrendered tax rolls of said City at the addresses
shown thereon; and when a special tax is proposed to be levied against any
railway or street railway using, occupying or crossing any highway or street,
portion or portions thereof to be improved, such additional notice shall be
given by depositing in the United States Mail, at least fourteen (14) days
before date of the hearing, a written notice of such hearing, postage prepaid,
in an envelope addressed to the said railway or street railway as shown on
the then current rendered tax rolls of said City, at the address so shown, or,
if the name of such respective railways do not appear on such rendered tax
rolls of the City, then addressed to such railways or street railways as the
names shown on the current unrendered tax rolls of said City, at the addresses
shown thereon. Said notice shall describe in general terms the nature of the
improvements for which assessments are proposed to be levied, shall state the
highway, highways, streets or portions thereof to be improved, state the esti-
mated amount or amounts per front foot proposed to be assessed against the
owner or owners of abutting property and such property on each highway, or
street or portion thereof with reference to which hearing mentioned in the
notice shall be held, and shall state the estimated total cost of the improve-
ments on each such highway, or street, portion or portions thereof, and, if
the improvements are to be constructed in any part of the area between and
under rails and tracks, double tracks, turnouts, and switches, and two (2)
feet on each side thereof of any railway, street railway or interurban, shall
also state the amount proposed to be assessed therefor, and shall state the
time and place at which hearing shall be held, provided, however, that any
failure of the property owners to receive said notice, shall not invalidate
these proceedings.
SECTION 7. That the need for the adoption of the plans and pro-
ceeding with the improvements as herein provided, and the importance of

promptly examining the report of the Director of Engineering and Physical
Development and making a decision thereon, creates a public emergency and
necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor or Council members, having declared such
emergency and necessity to exist, having requested•the suspension of said
Charter rule and that this ordinance be passed finally on the•datenof its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the 9th day of December ,

Mayor Luther Jones called the meeting to order at Carroll Lane Elementary
School and introduced the Council Members who were present.
Mayor Jones briefly explained the Carroll Lane and Mulberry Street
Reconstruction Project and stated that the public hearing pertaining to the
assessments was required by State law. He then introduced Mr. James K. Lontos,
Assistant City Manager.
Mr. Lontos explained that the project is one that involves the City and
the State under the Urban Systems Program. He stated that testimony will be
provided by Mr. Gerald Smith, Acting Director of the City's Engineering Depart-
ment, and by Mr. W. J. Holly, Real Estate Appraiser.
Assistant City Attorney Bob Coffin conducted the formal protion of the
hearing and called as his first witness, Mr. Gerald Smith. Through questioning
of the witness, Mr. Coffin ascertained that Mr. Smith is Chief Engineer of the
Engineering and Physical Development Department of the City of Corpus Christi
and has been employed in that capacity for 22 years. Mr. Coffin verified that
a copy of Mr. Smith's qualifications in resume form is on file in the Office of
the City Secretary.
Mr. Smith testified that he is thoroughly familiar with the project and
displayed a transparency which showed the various streets included in the• project,

(1) Carroll Lane, from South Staples Street to Gollihar Road,
(2) Carroll Lane, from South Padre Island Drive to Tiger Lane, and
(3) Mulberry Street, from Carroll Lane to Willow Street.
He stated that the project is being constructed jointly by the City and
the State Department of Highways and Public Transportation and.is an improvement
assessment project. Mr. Smith explained the construction of the streets, noting
that the improvements will provide for a roadway of 44' and 40' wide on Carroll
Lane and 28' wide on Mulberry Street within the existing right-of-way. He stated
that a new water line will be installed at City expense on Carroll Lane; the
improvements on Carroll Lane will be constructed with a 6" stablized subgrade, an
11" flexible base and 1>:" asphaltic concrete pavement; Mulberry Street will be
constructed with a 6" stablized subgrade, an 8" flexible base and 14" asphaltic
concrete pavement. Mr. Smith Informed the Council and the audience that all •
streets will have standard curb and gutter sections, 4" thick reinforced concrete
• sidewalks and 6" thick reinforced concrete driveways as shown on the plans.
Mr. Smith continued his testimony by stating that the plans for this work
were prepared in the local office of the State Department of Highways and Public
Transportation and the plans for Mulberry Street were prepared by the Engineering
Department of the City. He stated that bids were received by the State on
November 12 and APCCO submitted the low bid of $1,155,774.07; the State and
Federal portion of this amount is $690,674.07; the preliminary assessments total
$121,635.15; and the City portion of the cost is $343,464.85. Mr. Smith stated
•that the assessment roll consists of both residential and commercial properties
and the residential properties either front, back onto or side on the streets
involved.

Mr. Smith stated that the staff recommends that approximately 12 pieces
of property be credited for existing sidewalks that are being removed and replaced
and that the total of the credits equals $5,619.17.
`Council Member Cliff Zarsky arrived at the meeting at 7:30 p.m.
Chief Engineer Smith stated that the assessments will not be due until
after the work is completed and may be paid either by cash or in payments over a
five-year period at an interest rate of 6_$, or in case of hardship, this period .
may be extended to 10 years. He informed the Council that the contractor has 200
working days to complete the project; the contractor is in the process of install-
ing the water line; and they expect the project to be completed in about 10 months.
Assistant City Attorney Coffin called as his next witness, Mr. W. J. Holly,
the appraiser employed by the City.
Through questioning of this witness, Mr. Coffin ascertained that Mr. Holly
is a Real Estate Appraiser and Broker registered in the State of Texas; that he
has been in that business for approximately 27 years; and that he has served as
appraiser on a number of municipal Jobs. He stated that a copy of Mr. Holly's
resume, including all of his qualifications, is on file in the Office of the City
Secretary.
Mr. Holly testified that he is thoroughly familiar with all of the property
included in the assessment roll and stated that he discovered six odd -shaped pieces
of property which he feels would not be enhanced in the amount of the assessment
levied. He stated that he has recommended reductions on the following items:

Mr. Hulen B. Baskin, 3602 Tiger Lane, (Item S-93) stated that his property
already has curb, gutter and sidewalk on Carroll Lane on which his property sides
and inquired as to why he would not be given credit for the existing improvements.
Chief Engineer Smith explained that the improvements to this property were
built in 1963 and agreed that there are existing curb, gutter and sidewalks. He
stated that the sidewalk will not be removed, but the driveway will be lengthened
but credit will be given for the existing driveway. Mr. Smith explained that the
staff does not recommend a credit for the existing curb because it is eighteen
years old; it is a roll -type curb and it is laying over; and it would have been
necessary to remove it even if the street were not narrowed at this point.
Mayor Jones informed Mr. Baskin that he will personally examine the
property and provide a report for the Council.
Mr. Charles Hill, 3602 Bentwood Lane, (Item S-91) stated that he has
existing roll -type curb which he feels is in good condition. Mr. Hill also
pointed out that he has no access to Carroll Lane and he, therefore, feels that
he should not be assessed. He pointed out that the residents across the street
on Carroll Lane whose property does not have access are not being assessed and
expressed the opinion that he should be treated the same.
Mr. Smith explained that the curb at Mr. Hill's property is in the same
condition as that of Mr. Baskin and that the plat of Bentwood Subdivision restricts
access to Carroll Lane whereas the subdivision in which Mr. Hill resides does not
restrict access to Carroll Lane, and he is therefore being assessed.
Mayor Jones stated that he would visit Mr. Hill the following day at
2:00 p.m. and asked that a staff member accompany him to both residences.
Mr. Domiciano R. De Leon, 3601 Brushwood, (Item S-90) stated that his
curb, gutter and sidewalk are in good condition, and Mr. Smith informed him that
100% credit will be given for the sidewalk at his residence and credit will also
be given for the existing pavement.
Mr. Frank Blalock, 4222 Carroll Lane, (Item 17) asked about his existing
sidewalk, and Mr. Smith replied that the staff has recommended 100% credit on
his sidewalk assessment.

Mr, Diomede drlsstno, 3030 Santa Fe, (item 15) questioned why he was being
assessed the full rate since hi§ property sides on Carrell Lane. Mr, Smith
explained that property that is commercially Zoned is charged the full assessment,
but informed htm that there will be a credit to the existing sidewalk,
Mr: Smith then assured the property owner§ that all of the adjustments will
be made to the a§seasment roll before Its final approval by the Council,

Chief Engineer Smith assured him that the contractor will construct ane-
half of the street at a time and temporary access will be provided to driveways.
He admitted that for two or three days, the owners will not be.able to drive to
their property.

Mayor Jones expressed the Council's appreciation to those who attended the
meeting and urged that they support the upcoming bond election to be held on
February 20, 1982, pointing out that the bond program Is what makes the voluntary
paving program possible.
Mayor Pro Tem Turner also urged the members of the audience to support
the bond program.
Council Member Hawkins stated that he was very pleased to be present in
the neighborhood meeting and urged that the citizens call him if they have any
problems.
An unidentified lady in the audience inquired about the possibility of
the installation of traffic lights since there is a lot of fast traffic on the
street.
Mr. Tom Stewart, Director of Traffic and Transit, stated that no addi-
tional traffic lights or speed bumps are planned, but this will be reported to
the Police Department for enforcement of the speed limit.
There being no further business to come before the Council, on motion by
Mayor Pro Tem Turner, seconded by Council Member Hawkins, and passed unanimously,
the Special Council Meeting was adjourhed at 8:15 p.m., January 13, 1982.
