AN ORDINANCE
CLOSING AND ABANDONING THAT PORTION OF LEMONWOOD DRIVE
SOUTH OF ERSKINE DRIVE, BETWEEN LOT 14, BLOCK 4, AND
LOT 24, BLOCK 3, CANDLEWOOD ADDITION UNIT 7, AS RECORD-
ED IN VOLUME 36, PAGE 165, MAP RECORDS, NUECES COUNTY,
TEXAS, AS MORE FULLY SHOWN ON THE EXHIBIT ATTACHED
HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A", RE-
TAINING THE WEST 30 FEET OF RIGHT-OF-WAY ALONG THE
ENTIRE LENGTH AS UTILITY EASEMENT SUBJECT TO THE HERE-
INAFTER STATED PROVISIONS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the hereinafter more fully described portion of
Lemonwood Drive south of Erskine Drive, between Lot 14, Block 4, and Lot 24,
Block 3, Candlewood Addition Unit 7, as recorded in Volume 36, Page 165, Map
Records, Nueces County, Texas, as more fully described on the exhibit attach-
ed hereto and made a part hereof, marked Exhibit "A" be and the same is here-
by closed for public use and every municipal purpose retaining the west 30
Feet of right-of-way along the entire length as utility easement, said por-
tion of Lemonwood Drive being described as follows:
FIELDNOTES for the abandonment of a 50.00 foot wide street (Lemonwood
Drive) out of Candlewood Addition Unit -7, a map of which is recorded in Volume
36, Page 165, Map Records of Nueces County, Texas:
BEGINNING at a 5/8 inch iron rod on the Southwest subdivision line of said
Candlewood Addition Unit -7 for the West corner of this tract and the South corner
of rat 14, Block 4 of said Candlewood Addition Unit -7;
THENCE North 29°00'00" East, with the Southeast lot line of said Lot 14,
Block 4, 90.00 feet for the point of curvature of a circular curve to the left
which has a central angle of 90°00'00", a radius of 10.00 feet, a tangent dis-
tance of 10.00 feet and an arc length of 15.71 feet;
THENCE with said circular.curve to the left, 15.71 feet to a point on the
Southwest right-of-way line of Erskine Drive, same being the Northeast lot line
of said Lot 14, Block 4, for the point of tangency and the North corner of this
tract;
THENCE South 6i000'00;' East 70.00 feet to a point on the Northeast lot line
of Lot 24, Block 3 of said 'Candlewood Addition Unit -7 for the point of curvature
of a circular curve to the left whose radius point hears South 29°00'00" West
10.00 feet and which has a central angle of 90°00'00", a radius of 10.00 feet, a
tangent. distance of 10.00 feet and an arc length of 15.71 feet; said point of
curvature being the East corner of this tract;

THENCE with said circular curve to the left, 15.71 feet to a point on the
Northwest lot Iine of said Lot 24, Block 3 for the point of tangency;
THENCE South 29°00'00" West, with said Northwest lot line of said Lot 24,
Block 3, 90.00 feet to a point on said Southwest subdivision line of said Candle -
wood Addition Unit -7 for the West corner of said Lot 24, Block 3 and the South
corner of this tract;
THENCE North 61°00'00" West, with said Southwest subdivision line, 50.00
feet for the POINT OF BEGINNING.
SECTION 2. The aforesaid closing is subject to the following
provisions:
1. The applicant requesting the closure is to remove all street
and sidewalk, including storm sewer inlets, in said right-of-way.
2. Applicant shall construct the south side of Erskine Street
across the Lemonwood Drive intersection including any required driveways.
3. The plan of aforementioned provisions shall be as approved
by the Director of Engineering.
4. That the area to be closed shall revert to abutting property
owners.
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invlaid
or unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its purpose.
SECTION 4. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for;
efficient administration of City affairs by closing the aforementioned utility
easement, such finding'of an emergency is made and declared requiring suspen-
sion of the Charter rule as to consideration and voting upon ordinances or
resolutions at three regular meetings so that this ordinance is passed and
shall take effect upon first reading as an emergency measure this theTIL
day of December, 1981.

For the reasons set forth in the emergency clause of the foregoing ordinance or resolution,
an emergency exists requiring suspension of the Charter rule as to consideration and voting
upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you
suspend said Charter rule and pass this ordinance or resolution finally on the date it is
introduced, or at the present meeting of the City Council.
