HomeMy WebLinkAbout16766 ORD - 12/16/1981sp;12/14/81;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH BLACK & VEATCH, CONSULTING ENGINEERS, PROVIDING FOR THE PREPARATION OF A WATER DISTRIBUTION MASTER PLAN FOR THE CITY OF CORPUS CHRISTI; APPROPRIATING $115,000 OUT OF THE NO. 205 WATER SYSTEM BOND CON- STRUCTION FUND APPLICABLE TO PROJECT NO. 205-81-3, WATER DISTRIBUTION, TRANSMISSION, UNDERGROUND AND ELEVATED STORAGE SYSTEM MASTER PLAN FOR ENGINEERING FEES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Black & Veatch, Consulting Engineers, providing for the preparation•of a Water Distribution Master Plan for the City of Corpus Christi, a substantial copy of which agreement is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $115,000 out of the No. 205 Water System Bond Construction Fund applicable to Project No. 205-81- 3, Water Distribution, Transmission, Underground and Elevated Storage System Master Plan, for engineering fees. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the aforesaid agreement so that preparation of a Water Distribution Master Plan can begin at the earliest practicable date, such finding of an emergency is made and declared requiring suspension'of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of December, 1981. CONTRACT FOR ENGINEERING SERVICES THIS CONTRACT between the CITY OF CORPUS CHRISTI, TEXAS, hereinafter called Che "City", and BLACK & VEATCH, Consulting Engineers, hereinafter called the "Engineer"; SECTION I - SCOPE OF SERVICES The City hereby engages the Engineer to perform engineering services in connection with a Water Distribution, Transmission, Underground & Elevated Storage, and Pumping Master Plan Study, and a report on the present and future distribution system requirements, and supplemental services as requested. The work to be performed is listed in general below and further detailed in Appendix "A" for detailed work tasks, effort of level, and time budget. The selected effort level as shown in Appendix "A" is "Desirable Level". The services_which the Engineer agrees to perform are: A. To study the present and future use of water through the year 2002. The study will include areas not now served, but which are anticipated to develop and require service within the planning period. B. To review all data contained in past studies and operational reports, together with subsequent and current data as to production sales and distribution of water, and residential and industrial development. C. To develop Distribution & Transmission System Master Plan. The plan will also include any additional underground,•as well as elevated water storage and pumping facilities. D. To develop a schedule for construction of recommended improvements. The schedule will provide the basis for orderly development of dis- tribution system feeder mains, transmission mains, storage and pumping facilities to meet the anticipated demands within the service area. E. To prepare,a master plan containing field data, construction cost data, findings, recommendations and appropriate diagrams, charts and tables. Fifty (50) copies of the report: will be furnished the City. F. To start the field phase of the study in January, 1982, to staff the program with skilled personnel, who will be assigned to the project for the entire study, as shown in Appendix "B". G. To consult with the City Staff and various civic and public bodies such as Chamber of Contmcrce, U. S. Bureau of Census, City Planning Department, etc., to assure a fully coordinated program in accord with expected development of the area. H. To maintain a distribution system computer model in archive storage for future use upon request by the City. Future use of the computer model stored on the Black & Veatch computer will constitute addi- tional work as stipulated in VIII A. I. Upon completion of the Master Plan, Black & Veatch will supply the City with the computer program and input data used to develop the Master Plan. This will be supplied on computer cards or computer tape. It is agreed that the City may then use this program and data at the City's discretion. SECTION II - COMPENSATION For the services covered by this contract, the City hereby agrees to pay the Engineer as follows: A. The billing for services of all personnel actively engaged in the project will be charged at payroll costs times a multiplier of 2.0 to cover overhead and professional fee. Payroll costs are defined as salary plus 25 percent. B. Expenses will be billed on the basis of actual out-of-pocket travel, subsistence, computer, telephone, printing and other miscellaneous expenses incurred in connection with the services. C. It is mutually agreed and understood that the City shall not be liable for any amount in excess of ONE HUNDRED FIFTEEN THOUSAND DOLLARS ($115,000.00) for all services and expenses of the Engineer covered in the scope of this project. D. Monthly payments to the Engineer shall be made within thirty (30) days after billing is received by the City, unless the City has objections to tha billing or the report, which must first be mutually resolved. E. The Engineer will allow a credit of 10 percent of the total report fee, not to exceed 10 percent of the design fee, for any design - 2 - assignment arising as a result of the study. This offer is made in recognizing that a portion of any design assignment would require know- ledge obtained during the study for which the City has already paid. SECTION III - CITY'S RESPONSIBILITIES The City agrees to: A. Provide a working space in the City facilities to serve as local headquarters for the staff of the Engineer. This is only to the extent space is available at the Water Division offices. B. Furnish all data available for the pumping facilities, water dis- tribution system, and system storage together with recent data thereon. C. Provide available data from metered use of water and pumpage records. D. Provide personnel to conduct and assist Engineer in performance of flow test, pump tests or other work related directly to the operation of the water system. SECTION IV - TERMINATION OF CONTRACT Either party to the contract may terminate the contract by giving to the other thirty (30) days notice in writing. Upon delivery of such notice by the City to the Engineer, and upon expiration of the thirty -day period, the Engineer shall discontinue all services in connection with the performance of the agreement and shall proceed to cancel promptly all existing orders and contracts insofar as such orders or contracts are chargeable to this contract.. As saon•as practicable after receipt of notice of termination, the Engineer shall submit a statement showing in detail the services performed under this contract to the date of termination. The owner shall then pay the Engineer promptly that proportion of the prescribed charges which the services actually performed under this contract bear to the total services called for under this contract, less such payments on account of the charges as have been previously made. Copies of all completed or partially completed designs, plans and specifications prepared under this contract shall be delivered to the owner when and if it is•terminated. SECTION V - TINE AND ORDER OF ENGINEER'S SERVICES The Engineer shall furnish the documents and personally render or'provide the services required by this contract within 270 days, as laid out in the time schedule. SECTION VI - ASSIGNABILITY The Engineer shall not assign, transfer or delegate any of his obligations or duties in this contract to any other person without the prior written consent of the City, except for the routine duties delegated to personnel of the Engineer's staff. If the Engineer is a partnership, in the event of the termination of the partnership, this contract shall inure to the individual benefit of such partner or partners as the City may designate. No part of the Engineer's fee may be assigned in advance of receipt by the Engineer without written consent of the City. SECTION VII - OWNERSHIP OF DOCUMENTS Upon completion of the project (or upon the termination of this contract, if previously terminated) the Engineer shall furnish to the City all completed work and such work then shall become the property of the City. This includes the com- puter model as described in Section I, I. If the contract is terminated prior to completion of the Master Plan, the computer program and input data developed to the date of termination will be given to the City. SECTION VIII - OTHER MATTERS It is mutually understood and agreed: A. That during the course of this study, the City may request such additional work beyond the scope of Section I and detailed in Appendix "A" on the basis set forth in Section II provided the amount stipulated in Section II C is increased. B. That the Engineer shall not be liable for delays resulting from _ ___causes beyond the reasonable control of the Engineer; that the Engineer has made no warranties, expressed or"implied, which are not expressly set forth in this contract; and that under no circumstances will the Engineer be liable for indirect or consequential damages. Preliminary Work 101. Meet with City Staff to define Scope of Study. 102. Collect and inventory all available studies and reports dated 1960 or later. 103. Review available reports and evaluate information contained therein. 104. Compile data received from City. 105. Collect field data. SUB - TOTAL - Preliminary Work 200. Population and Land Use. 201. Determine Study Area. The areas should go to Oso Creek with Distribution & Transmission system beyond the creek to the south. 202. Review available demographic studies prepared by and for City. 203. Review 1980 Census Tracts Report. - 204. Review and evaluate population projec- tions contained in existing studies fur- nished by the City. 205. Prepare a population projection based on the evaluation as outlined above. Meet with City staff for comment. 206. Determine a projected growth pattern for the land use and housing density based on evaluation of the available data. SUB TOTAL - Population and Land Use 300. Water Requirements 301. From records made available by the City, determine the historical water require- ments. This determination shall include average day, maximum day, peak hour, un- accounted for water, and ratios of maximum day to average day and peak hour to maximum day. 302. From records made available by the City, establish historical water usage by cus- tomer classification; Residential, Commercial and Industrial. Review water storage and/or pumping facilities to meet fire -flow requirements established by the Insurance Services Offices. 307. Draw Base map showing all 12 inch and larger mains and smaller mains where necessary to be used as base for computer grid map and recommended improvement map. 402. Determine pipe sizes and lengths from City maps 403. Prepare a computer grid map showing all mains and junctions to be used in the system analysis. This map will be com- piled from existing maps furnished by the City and new base map. 404. Evaluate data available for estimating "C" values. - 405. Establish and assist the City in conduc- ting a program of field testing to esti- mate "C" values in areas where existing data is not adequate. 406. Evaluate maintenance alternatives for deteriorating large transmission mains including slip lining. 407. Establish and conduct a program of field testing the existing high service and booster pumps.
