AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH T & H DEVELOPMENT OF CORPUS CHRISTI, DEVELOPERS
OF CREEKWAY SUBDIVISION, A COPY OF WHICH IS ATTACHED
HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A",
PROVIDING FOR THE CITY TO REIMBURSE THE DEVELOPER
FOR PARTIAL COST OF INSTALLATION OF A 12 INCH ASBES-
TOS CEMENT WATERLINE ALONG DELWOOD STREET AND PRAIRIE
DRIVE IN THE CREEKWAY SUBDIVISION; APPROPRIATING
$20,515.82 OUT OF THE NO. 141 WATER FUND, DEPARTMENT
361, ACTIVITY 541.61, CODE 248; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute an agreement with T & H Development of Corpus Christi, developers
of Creekway Subdivision, a copy of which is attached hereto and made a part
hereof, marked Exhibit "A", providing for the City to reimburse the developer
for partial cost of installation of a 12 inch asbestos cement waterline along
Delwood Street and Prairie Drive in the Creekway Subdivision.
SECTION 2. That there is hereby appropriated $20,515.82 out of
the No. 141 Water Fund, Department 361, Activity 541.61, Code 248, to pro-
vide funds for the agreement.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need of
executing the aforesaid agreement so that the developer of Creekway Subdivis-
ion can be reimbursed for partial cost of installation of the waterline at the
earliest possible date, such finding of an emergency is made and declared re-
quiring suspension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this ordinance is
passed and shall take effect upon first reading as an emergency measure this
the day of December, 1981.

COUNTY OF NUECES
This Agreement is entered into between the City of Corpus Christi, Texas,
a municipal corporation and body politic, operating under the home rule statutes
of the State of Texas, hereinafter called "City", and T & H Development of Corpus
Christi, hereinafter referred to as "Developer", and pertains to the City's share
of the cost for improvements as set forth in the Platting Ordinance and for
improvements required by the City over and above those set forth in the Platting
Ordinance for oversizing of the 12" water lines in Delwood Street from Everhart
Road to Prairie Drive, and in Prairie Drive from Delwood Street to Cedar Pass
Drive and for the addition of the 12" water line in Cedar Pass Drive from Prairie
Drive to 184 feet East as shown on the plat attached hereto, marked Exhibit "A".
NOW, THEREFORE, City and Developer agree as follows:
1. Developer will construct the 12" asbestos cement pipe water line on
Delwood Street from Everhart Road to Prairie Drive and on Prairie Drive from
Delwood Street to Cedar Pass Drive and on Cedar Pass Drive from Prairie Drive
to 184 feet East, said construction to be contracted for and financed by Developer.
2. City agrees to reimburse Developer as its share of the cost of the
above stated construction (including engineering at the rate of 7.5% of the
construction cost), the sum of Twenty Thousand, Five Hundted, Fifteen and 82/100
Dollars ($20,515.82) upon satisfactory completion and acceptance of the improve-
ments by City.
3. Developer agrees to idemnify City against any and all claims arising
out of the construction of the aforesaid improvements.
