Home My WebLink About16793 ORD - 12/30/1981AN ORDINANCE GRANTING A REVOCABLE EASEMENT TO DEL MAR COLLEGE FOR INSTALLATION OF UNDERGROUND ELECTRIC DUCTS AND CHILLED WATER LINES IN KOSAR AND TOMPKINS STREETS TO SERVE,A:NEW HEALTH SCIENCES BUILDING, ALL AS MORE FULLY SET FORTH IN THE REVOCABLE EASEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a revocable easement to Del Mar College for installation of under- ground electric ducts and chilled water lines in Kosar and Tompkins Streets to serve a new health sciences building, all as more fully set forth in the revocable easement, a substantial copy of which is attached hereto and made a part hereof, marked exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the revocable easement described hereinabove, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 30th day of December, 1981. BRUCE AYCOCK, TY ATTQRNEY By L)......- MAYOR THE CIT OF CORPUS CHRISTI, TEXAS 1.6793 Sgp 2 81984 SEP 1984 WOWED s REVOCABLE EASEMENT THE STATE OF TEXAS X COUNTY OF NUECES ) THAT, the City of Corpus Christi, Texas, acting by and through its duly authorized Acting City Manager, Ernest Briones, for and in consideration of the sum of One Dollar ($1.00) to it in hand paid by Del Mar College, hereinafter referred to as "Owner", the receipt of which is hereby acknowledged and confessed, has granted, sold, and conveyed, and by these presents does Grant, Sell and Convey, upon the conditions herein stated, unto the said Owner, the right to construct underground electrical and chilled water lines within the street right-of-way of Kosar Street and Tompkins Street to provide new service to buildings on the "East" campus. NOW, THEREFORE, the City and Owner agree as follows: 1. The City grants Owner permission to install said facilities crossing said street right-of-ways located as shown on attached Exhibit "A". 2. Facilities are to be minimum 36 inches deep, street cuts are to be repaired to original or better condition by backfilling with sand, 6 inches caliche, and 2 inches Hot Mix minimum. 3. The Owner will save and keep harmless the City from any and all claims for liability by reason of the installation of said utilities. 4. It is understood and agreed that the rights herein granted may be revoked at any time by the City, and the Owner may be required to remove said utilities upon ninety (90) days notice in writing. 5. All rights granted hereby shall be subordinate to all uses the City may make of such street right-of-way for public purposes. 6. The Revocable Easement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors and assigns from and after the date of execution.
