HomeMy WebLinkAbout16795 ORD - 12/30/1981ORDINANCE N0. 1J 795 AN ORDINANCE PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED BETWEEN THE STATE OF TEXAS AND THE CITY OF Corpus Christi , FOR THE INSTALLATION, CONSTRUCTION, EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY SIGNAL PROJECT(S) AT THE LOCATION(S) SHOWN ON EXHIBIT 1, ATTACHED HERETO AND MADE A PART HEREOF, IN THE CITY OF Corpus Christi ; PROVIDING FOR THE EXECUTION OF SAID AGREEMENT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Cornus Christi SECTION 1. That the certain agreement dated between the State of Texas and the City of Corpus Christi , for the installation, con- struction, existence, use, operation, and maintenance of certain highway traffic signal(s) at the location(s) shown on EXHIBIT 1, attached hereto and made a part hereof, in the City of Corpus Christi , be and the same is hereby approved, and is hereby authorized to execute said agreement on behalf of the City of Corpus Christi , and to transmit the same to the State of Texas for appropriate action. SECTION 2. The fact that the improvements contemplated under the above mentioned agreement are needed, creates an emergency which for the immediate preservation of the public peace, health, safety, and general welfare requires that this Ordi- nance take effect immediately from and after its passage, and it is accordingly so ordained. W I T N E S S E T H WHEREAS, there isc (are) (xx) highway traffic signal(s) in place at the location(s) shown on EXHIBIT 1, attached hereto and made a part hereof, said high- way traffic signal(s) having been installed, operated, and maintained by the State at a time when said location(s) xea t(were) not within the corporate limits of the City; and WHEREAS, said locations) xbsc(are) now within the corporate limits of the City; and WHEREAS, it is not the policy of the State to install, operate, or maintain highway traffic signals inside the corporate limits of cities of 15,000 population and over (latest Federal Census), except on expressway type facilities; and WHEREAS, the City, which now equals or exceeds 15,000 population, has re- quested the State to leave the highway traffic signal(s) in place at the location(s) shown on EXHIBIT 1 and has authorized the continued existence, use, operation, and maintenance of the highway traffic signal(s) by Ordinance/Resolution passed on the day of ,19 ACRUMENT (TRAFFIC SIGNAL - TYPE 3A) 10-79-804, 0-18T 1-4 AGREEMENT• therefore, In consideration of IIn plenifn n and of the mutual cove- nants and agreements of the parties hereto t. be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows. 1. The City will operate and maintain the signal(s). 3. The City will pay all power costs for operating the signal(s). 4. The City will obtain written approval of the State Department of Highways and Public Transportation before making any changes in the design of operation and timing of the signal(s) or before removing any part -of -the instal- lation(s). 5. The City will return any and all parts of said highway traffic signal installation(s) to the State should ,et (they) be removed by the City for any reason other than for installation on a State or Federal numbered highway route at a location approved by the State. 6. In the event the terms of this Agreement are in conflict with the provisions of any other existing Agreements and/or Contracts between the City and the State, this Agreement shall take precedence over the other Agreements and/or Contracts.
