HomeMy WebLinkAbout16800 ORD - 12/30/1981AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JOHN McLAUGHLIN, JR. 4 BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT "A" AND TRACT "B", BEING OUT OF THE PETERSON TRACT SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B -1A" TOURIST COURT DISTRICT ON TRACT "A" AND "B -1A" IUURISI CUURI UISIRICT AND "R -1B" ONE FAMILY DWELLINs UISIKILI 10 "T -IA" 1RAVEL [RAILER PARK DISTRICT ON TRACT "A" AND "T -1B" MOBILE HOME PARK DISTRICT ON TRACT B; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of John McLaughlin, Jr. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday December 30, 1981 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall__in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 16800 sgp 2 81994 'SEP 2 1AR i} AIICBOEILMED SECTION 2. That the zoning of Tract "A" be and the same is hereby changed from "B -1A" Tourist Court District to "T -1A" Travel Trailer Park District and.that the zoning of Tract B be and the same is hereby changed from "B -1A" Tourist Court District to "T -1B" Mobile Home Park District, said tracts being out of the Peterson Tract and being more fully described as follows: TRACT A BEING a 2.835 acres of land, more or less, out of 9.47 acre out of Frances Hatch Tract, out of Peterson Tract, out of E. Villareal Survey, Nueces County, Texas, and more particularly described by metes and bounds as follows: - BEGINNING on southwest right-of-way line of Up River Road at the north- west corner of Holy Cross Cemetery; THENCE, along the west line of said Holy Cross Cemetery, South 01° 47' 00" east, a distance of 741.68 feet to a point for an easterly corner of this tract; THENCE, South 88° 13' 00" west, a distance of 52.00 feet to a point for an interior corner of this tract; THENCE, South 01° 47' 00" east. a distance of 222.00 feet to a point for a southerly corner of this tract; THENCE, South 88° 13' 00" west, a distance of 78.00 feet to a point for the southernmost comer of this tract; THENCE, North 01° 47' 00" west, a distance of 16.00 feet to a point for a westerly corner of this tract; THENCE, North 13° 47' 39" east, a distance of 207.18 feet to a point for an interior corner of this tract; THENCE, North 010 53' 42" west, a distance of 276.00 feet to a point for an interior• corner of this tract; THENCE, South 88° 06' 18" west, a distance of 107.00 feet to a point for westerly corner of this tract; THENCE, North 01° 53' 42" west, a distance of 15.00 feet to the southeast corner of Jasperson Tract; THENCE, North 01° 53' 42" west, a distance of 335.09 feet to a point for a westerly corner of this tract; THENCE, North 00° 24' 48" east, a distance of 67.65 feet to a point for an easterly corner of this tract; THENCE, along the said east line of the Jasperson Tract North 01° 33' 12" west, a distance of 122.10 feet to the said southwest right-of-way line of Up River Road; THENCE, along the said southwest right-of-way South 71° 11' 00" east, a distance of 191.76 feet to the POINT OF BEGINNING. TRACT B BEING a 6.673 acres of land, more or less, out of 9.47 acre out of Frances Hatch Tract, out of Peterson Tract, out of E. Villereal Survey, Nueces County, Texas, and more particularly described by metes and bounds as follows: BEGINNING at a point in the west line of Holy Cross Cemetery which bears North 01° 47' 00" west, a distance of 741.68 feet to the northwest corner of said Holy Cross Cemetery and the southwest right-of-way of Up River Road; THENCE, along said west line of Holy Cross Cemetery South 01° 47' 00" east, a distance of 420.00 feet to southeast corner of this tract; THENCE, South 88° 12' 43" west, a distance of 544.41 feet to the east boundary line of Westgate Heights Subdivision as recorded in Volume 8, Page 25, Map Records, Nueces County, Texas, for the southwest corner of this tract; THENCE, along the said east boundary line of Westgate Heights Subdivision North 02° 05' 07" west, a distance of 236.57 feet to the southwest corner of the Congregation of the Sisters of Charity of Incarnate Word tract; THENCE, South 71° 17' 24" east, a distance of 143.84 feet to a point for -an interior corner of -this tract; THENCE, North 01° 32' 08" west, a distance of 561.33 feet to a point for a westerly corner of this tract; - THENCE, North 88° 27' 38" east, a distance of 134.03 feet to the south- west corner of the Jasperson Tract; THENCE, along the common boundary line between the said Jasperson Tract and this tract runs South 67° 05' 12" east, a distance of 101.85 feet to the southeast corner of the Jasperson Tract; THENCE, South 010 53' 42" east, a distance of 15.00 feet to a point for an interior corner of this tract; THENCE, North 88° 06' 18" east, a distance of 107.00 feet for a easterly corner of this tract; THENCE, South 01° 53' 42" east, a distance of 276.00 feet to a point for an easterly corner of this tract; THENCE, South 13° 47' 39" west, a distance of 207.18 feet to a point for an interior corner of this tract; THENCE, South 01° 47' 00" east, a distance of 16.00 feet to a point for an interior corner of this tract; THENCE, North 88° 13' 00" east, a distance of 78.00 feet to a point for an interior corner of this tract; THENCE, North 01° 47' 00" west, a distance of 222.00 feet to a point for an easterly corner of this tract; THENCE, North 88° 13' 00" east, a distance of 52.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon )first reading as an emergency measure this the ,39 day of ATTEST: City Secretary APPROVED: 3n DAY OFc-2110 J.
