FOR DISPOSAL OF A 300 KVA ELECTRICAL TRANSFORMER AT THE CORPUS CHRISTI INTERNA- TIONAL AIRPORT, A COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AUTHORIZING A TRANSFER OF $13%472 FROM THE NO. 117 AIRPORT FUND RESERVE, ACTIVITY 546.99 TO THE AIRPORT OPERATING BUDGET,.DEPARTMENT NO. 365, ACTI- VITY 546.31, CODE 345 TO PROVIDE FUNDS FOR THIS AGREEMENT; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with Bath Electrical Systems, Inc. for disposal of a 300 KVA electri- cal transformer at the Corpus Christi International Airport, a copy of which agreement is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby authorized a transfer of $13,472 from the No. 117 Airport Fund Reserve, Activity 546.99 to the Airport Operating Budget, Department No. 365, Activity 546.31, Code 345 to provide funds for this agreement. SECTION 3. That upon written request of the Mayor or Council members, copy attached, to find and declare an emergency due to the need of executing the aforesaid con- tract so that disposal of an electrical transformer at the Airport can take place at the earliest practicable date, such finding of an emergency is made and declared requiring suspension fo the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take 16803 SEP 2 8 1984 MICROFILMED effect upon fir reading as an emergency measure this the P$4 day of r, 1982.- e ATTEST: APPROVED: i2420,....tDAY OF DECEMBER, 1981 . Bruce Aycoc City Attorney MA 0 Or THE TY OF CORPUS CHRISTI, TEXAS AGREEMENT SPECIAL SERVICES The City of Corpus Christi, Texas, hereinafter called CITY, and Bath Electrical Systems, Inc., hereinafter called CONTRACTOR, agree as follows: I. Services to be performed: The Contractor hereby agrees at his own expense, to dispose of one 300 KVA Uptegraff Electrical Transformer containing approximately two hundred and six (206) gallons of Polychlorinated BiPhenyl (PCB) contaminated coolant oil located at Corpus Christi International Airport Terminal Building Baggage Claim Area. All disposal methods and procedures shall be in accordance with current United States Government Environ- mental Protection Agency Rules, Regulations and Guidelines. II. Time of Completion and Coordination of the Work: The Contractor shall remove the transformer and coolant oil from the Airport premises within five (5) working days from the time the transformer is removed from service by the Terminal Building Renovation Contractor, Braselton Construction Company. /t is anticipated that the transformer will be available for removal within the first 60 calendar days of 1982. The Contractor shall coordinate his work through the following personnel: John Pinson, Assistant Airport Manager 289-0171 Gordon Landreth, Cotten/Landreth Architects 884-3295 III. Compensation: Ihe City agrees to pay the Contractor for his services, the sum of Thirteen Thousand Four Hundred Seventy Two and no/100--- Dollars ($13,472.00). Such payment and price shall constitute full compensation for all labor, equipment, materials, permits and performance of all work necessary to -dispose of the transformer and coolant oil. Payment shall be rendered by the City upon receipt of invoice and affidavits that material has been disposed of in accordance with the conditions set forth in this agreement. IV. Responsibility for Damage Claims: The Contractor shall indemnify and save harmless the City and all its officials, agents and employees from all suits, action or claims of any character, name and description brought for, or on account of, any injuries or damages received or sustained by any person, persons, or property, by or from the said Contractor or his employees or by or in consequence of any negligence in safeguarding the work or on account of any Page 1 of 2 act or omission, neglect or misconduct of the said Contractor, or by or on account of any claims or amounts recovered under the Workmen's Compensation Law or any other law, ordinance, order or decree, and so much of the money due the said Contractor under and by virtue of his contract as shall be considered necessary by the City may be retained for the use of the City; or in case no money is due, his sureties shall be held until suit or suits, action or actions, claim or claims for injury or damages as aforesaid shall have been settled and satisfactory evidence to that effect furnished the City. As further and additional evidence of such indemnification the Con- tractor shall furnish certificates of insurance providing that his interest are adequately covered by the following: A. Workmen's Compensation Public Liability 1. Bodily Injury 2. Property Damages C. Vehicular Liability 1. Bodily Injury 2. Property Damage $50,000 - $100,000 $25,000 - $100,000 $50,000 - $100,000 $25,000 This coverage is to include all cars and trucks owned, rented, hired or leased, and others of non -ownership nature used by employees in and around or in connection with the particular contract.
