HomeMy WebLinkAbout16827 ORD - 01/20/1982AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO: 1 TO THE AGREEMENT WITH URBAN EINGEERING SERVICES TO BE PROVIDED IN CONNECTION WITH THE CITY'S STEP 1 GRANT APPLICATION TO THE ENVIRONMENTAL PROTECTION AGENCY FOR IMPROVEMENTS. TO THE ALLISON WASTEWATER TREATMENT PLANT, EPA PROJECT NO. C-48-1457-01, SAID AMENDMENT TO PROVIDE FOR ARCHEOLOGICAL RESEARCH IN THE ALLISON PLANT SITE TO DETERMINE THE EXTENT OF PREHISTORIC HABITATION, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; APPROPRIATING $9,059 OUT OF THE NO. 250 SANITARY SEWER BOND FUND, BOTH IN THE AWARD AND THE APPROPRIATION BEING SUBJECT TO APPROVAL FROM THE TEXAS DEPARTMENT OF WATER RESOURCES AND THE ENVIRONMENTAL PROTECTION AGENCY, APPLICABLE TO PROJECT NO. 250-77-17, ALLISON PLANT IMPROVEMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the City Manager be and he is hereby authorized to execute Amendment No. 1 to the agreement with Urban Engineering for engineering services to be provided in connection with the City's Step I grant application to the Environmental Protection Agency for improvements to the Allison Wastewater Treatment Plant, EPA Project No. C-48-1457-01, said amendment to provide for archeological research in the Allison plant site to determine the extent of prehistoric habitation, all as more fully set forth in the amendment, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated $9,059 out of the No. 250 Sanitary Sewer Bond Fund, both the award and the appropriation being subject to approval from the Texas Department of Water Resources and the Environmental Protection Agency, applicable to Project No. 250-77-17, Allison Plant Improvements. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the aforesaid amendment so that engineering services for the improvements to the Allison SEp 1984 TAICROFILMEW 16827 Wastewater Treatment Plant can proceed without undue delay, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency this the ...Z9 day of January, 1982. Step 1 Study for Improvements to the Allison Wastewater Treatment Plant, also known as E.P.A. Project No. C-48-1457-01, approved by the Corpus Christi City Council by Ordinance No. 15555 on May 21, 1980. SECTION A - SCOPE OF WORK The scope of work is amended by adding the following: 1. Contract with a qualified consulting archeological firm for detailed investigation of archeological sites discovered in the area of the proposed Allison Plant expansion. 2. Provide supervision during the archeological testing. 3. Review written report and findings submitted by the contracted archeological firm. 4. Submit an Engineering Report and recommendation to the City con- cerning any archeological findings. SECTION B - TIME OF PERFORmANCE The time of performance for work covered in this amendment is as follows: 1. Complete field work after approval to 30 days proceed with Archeological Testing. 2. Submit findings report to DEPARTMENT 60 days after approval to proceed with Archeological Testing. SECTION C - COMPENSATION FOR ENGINEERING SERVICES The City shall compensate the Engineer for services rendered in compliance with current E.P.A. guidelines as defined in the Federal Register, Vol. 40, No. 243, Wednesday, December 17, 1975. Payment will be based on the "fixed price" method with the fixed price to be Nine Thousand, Fifty -Nine dollars ($8,059) for the archeological testing and evaluation. Said amount shall be an addition to the provisions of original Agreement for Step 1 Engineering, Services. SECTION D - APPROVAL BY THE DEPARTMENT AND E.P.A. This agreement shall not become effective until formally approved by the DEPARTMENT and/or E.P.A. Formal approval shall be evidenced by approval letters separately issued and signed by a duly authorized representative of the DEPARTMENT and/or E.P.A. The approval so evidenced x by tlie DEPARTMENT and E.P.A. shall in no way commit the DEPARTMENT or E.P.A. to render financial assistance to the OWNER, but in the event such assistance is provided, the approval shall signify that the provisions of this Agreement are consistent with the requirements of the DEPARTMENT and E.P.A. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in duplicate on the respective dates indicated below. NO. C-48-1457-01 DECEMBER, 1981 URBAN ENGINEERING JOB NO. 16445.12 NARRATIVE STATEMENT The City of Corpus Christi owns and operates the Allison Wastewater Treatment Plant on the west side of the City. The treatment plant is located on some 133 acres owned by the City along the Nueces River. The treatment plant, though, only uses a small portion of the property. A Facilities Plan studying alternative methods for expanding the existing treatment system has recently been completed. The recommended plan is the conversion and expansion of the existing 2.0 MGD contact stabilization plant to a 5.0 MGD complete mix plant. This expansion requires additional land adjacent to the existing plant site. An archeological reconnaissance of the proposed expansion area was conducted by staff archeologist of the Texas Department of Water Resources (TDWR). Two prehistoric archeological sites were discovered, one of which apparently would be impacted by the proposed plant expansion. It was determdned that this archeological site is potentially very significant and should be thoroughly examined if it is to be affected by construction. Testing involves the controlled excavation of small holes and pits in the proposed expansion area to determine if archeological materials are buried there and to recover information needed to evaluate the significance of the site. The Staff of the TDWR is unable to conduct this intensive of an investigation. The additional funds requested herein are for the purpose of contracting with a qualified archeological firm for the required site investigation. A written report of the results will be provided at the conclusion of the archeological investigation. It has been assured that the City of Corpus Christi has available the necessary 25% share of the increased funds.
