HomeMy WebLinkAbout16832 ORD - 01/20/1982AN ORDINANCE AUTHORIZING ACCEPTANCE OF A RIGHT-OF-WAY EASEMENT DEDICATION FOR THE KENTNER STREET IMPROVEMENTS BETWEEN HOMECREST STREET AND UNIVERSITY DRIVE, PARCEL NUMBER 1; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a right-of-way easement dedication for the Kentner Street Improvements between Homecrest Street and University Drive, Parcel Number 1, be accepted, a substantial copy of which easement is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of accepting the abovementioned right-of-way easement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolu- tions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency this the .420/day of January, 1982. Coover, Jr., Independent Executor of the Estate of David M. Coover, deceased, - of the County of Nueces, State of Texas, for and in considera- tion of the sum of ONE DOLLAR AND NO CENTS ($1.00) to me . in hand paid by the City of Corpus Christi, Nueces County, Texas, and other good and valuable considerations, the receipt of which is hereby acknowledged, have granted and con- veyed and by these presents do grant and convey unto the City of Corpus Christi, Nueces County, Texas, a municipal corpora- tion duly incorporated under and by virtue of the laws of the State of Texas, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas, and being described as follows: Being a parcel of land out of Lot 17, Block 3, Ocean Drive Addition, as shown by map of record in Volume 22, Page 6, Map Records of Nueces County, Texas and being more particularly described as follows: Beginning for the same at the south corner of said Lot 17, said corner also being the intersection of the northerly right-of-way line of Kentner Drive and the westerly right-of-way line of Claremore Street; Thence westerly on and along said northerly right- of-way line of said Kentner Drive N. 61° W., a dis- tance of 300.00 feet to the west corner of said Lot 17, said corner also being the intersection of said northerly right-of-way line of Kentner Drive and the westerly line of said Lot 17; Thence northerly on and along said westerly line of said Lot 17 N. 29' E., a distance of 25.00 feet to a point; Thence southerly along a curve to concave to the west, having an initial tangent bearing S. 29° W., a central angle of 900, a radius of 10 feet and a distance along the curve of 15.71' to a point; Thence easterly along a line parallel to, and 15.00' north of said northerly right-of-way line of Kentner Drive, S. 61° E., a distance of 280.00' to a point; Page 1 of 5 Exhibit A Thence easterly along a curve concave to the north having an initial tangent bearing S. 61° E., a cen- tral angle of 900, a radius of 10' and a distance a- long the curve of 15.71' to a point on the westerly right-of-way line of Claremore Street, said line also being the easterly line of said Lot 17; Thence southerly on and along the said westerly right-of-way line of said Claremore Street S. 29° W., a distance of 25.00' to the principal point of beginning; Containing 0.10 acres of land, more or less. - A map of which is marked "Exhibit- A" and attached hereto and made a part hereof for all purposes. It is agreed that when Kentner Street is paved the abutting property owner will be required to pay the paving assessment in accordance with the City Assessment Policy. Together with the free ingress, egress and regress to and for the City of Corpus Christi, for the purpose of constructing streets, sidewalks, curbs, gutters and appurtenances upon said tract and way for the public use by foot, with automobiles, carts, carriages and all other vehicles and all other means of transportation necessary or convenient at all times and in all seasons in, along and upon said tract and way, as well as for laying, repairing, servicing, and maintaining of public utility lines and storm sewers in, on, over, under, and along said tract or way. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives and the public, for the proper use as public streets and utility easements or utility easements for so long as used for such purposes or any of them, and if the use for said tract and way for all of said uses be ever abandoned, then in that event, the aforesaid rights and privileges shall cease and all rights herein granted shall revert to the Grantor herein, his heirs or assigns.
