AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT
WITH JOSE F. VELA, JR., FOR SPACE LOCATED AT 105 NORTH ASH
IN BISHOP, TEXAS, FOR AN INITIAL TERM OF TWO YEARS WITH AN
OPTION TO RENEW FOR AN ADDITIONAL TWO YEARS, FOR USE AS A
TITLE III NUTRITION PROGRAM MEAL SITE AND SOCIAL SERVICE
CENTER UNDER THE SENIOR_COMMUNITY SERVICES PROGRAM, ALL
AS MORE FULLY SET FORTH IN THE LEASE AGREEMENT, A SUBSTAN-
TIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A",; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized to
execute a lease agreement with Jose F. Vela, Jr., for space located at 105
North Ash, Bishop, Texas, for an initial term of two years with an option to
renew for an additional two years, for use as a Title III Nutrition Program
Meal Site and Social Service Center under the Senior Community Services
Program, all as more fully set forth in the lease agreement, a substantial
copy of which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
executing the aforesaid lease agreement in order to provide meal site and
social center for the Senior Community Services Program, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances or resolutions at three regular
meetings so that this ordinance is passed and shall take effect upon first
reading as an emergency measure this the -34 day of February, 1982.

LEASE AGREEMENT
THE STATE OF TEXAS
COUNTY OF NUECES
This agreement is entered into by and between Jose F. Vela, Jr.,
524 E. Alice, Kingsville, Texas, hereinafter called LESSOR, and the City of
Corpus Christi, a municipal corporation located in Corpus Christi, Nueces
County, Texas, hereinafter called LESSEE, acting by and through Ernest M.
Briones, Acting City Manager, for the use and occupancy of the below described
premises, under the following terms:
ARTICLE I
Terms of the Lease
A. The terms of this lease shall be for two years, commencing
December 28, 1981, and ending December 27, 1983, unless terminated prior
to that date as hereinafter provided. Lessor hereby leases to Lessee the
land and improvements located at 105 North Ash, Bishop, Texas, hereinafter
called "leased premises."
B. The Lessee has the option to renew this lease for a further
period of two years in one-year increments on the same rental terms by giv-
ing Lessor thirty days written notice of its election to do so.
C. Either party may terminate this lease upon thirty days written
notice to the other party.
D. On the date of termination of this lease, Lessee agrees to
surrender the property covered by this lease,and all permanent improvements
placed on the property by Lessee shall become the property of Lessor.
E. Lessor will make the following improvements prior to occupancy
by Lessee:
1. Two restrooms will be fully functional by the date of
occupancy. Improvements will be necessary to the plumb-
ing and to the interior of the restrooms. Interior
improvements will include lighting and any necessary
painting and sheetrock work.
2. Handwashing facilities will be available in each rest-
room.
3. The exterior hall leading to the restroom will be fully
enclosed and lighted.
4. Plumbing will be inspected to meet building code require-
ments.
5. Front and back doors will be replaced with solid core -
doors and double locks.
6. Electrical wiring will be inspected to meet building
code requirements.
7. Four electrical outlets will be installed; two will
be 220 voltage and two will be 120 voltage.
8. Electrical lighting fixtures will be replaced.
9. The premises wi31 be cleared of all debris.
ARTICLE II
Compensation
A. In consideration for the lease, the Lessee shall pay Lessor
the sum of One Hundred Eighty -Five Dollars ($185.00) each month for the
duration of the lease.
B. Lessee will be responsible for paying all utilities used in
connection with the lease.
ARTICLE III
Use
A. The leased premises are to be used by Lessee as a Senior
Citizens Center during the hours of 9:00 a.m. to 3:00 p.m., Monday through
Friday, to offer nutrition services, social services, and recreational
services to the elderly residents of Bishop, Texas.
B. Lessee may share the leased premises with other agencies as
requested by Lessee but Lessee will be responsible for the activities of
such other agencies and may restrict such activities if not in keeping
with policies of Lessee.
ARTICLE IV
Indemnification
A. Lessor indemnifies and holds harmless Lessee against any and
all liability incurred as result of Lessor's failure to make necessary
repairs to the demised premises or as result of Lessor's negligence in not
making any necessary repairs to the premises.
B. Lessee shall maintain sufficient liability insurance to cover
injury or damage caused to property or persons on the leased premises
during normal operating hours. Lessee will indemnify and hold Lessor harm-
less from liability for damages which are proximately caused by the negligence
of Lessee or its staff.

C. Lessee agrees to comply with all ordinances and regulations
of the City and other governmental agencies which are applicable to the use
of the leased premises during the term of this lease.
ARTICLE V
Right to Access
Lessor shall have the right of access, at reasonable times, for
examining said premises and for making necessary repairs, and shall be
limited to such activities unless prior notice is given Lessee.
ARTICLE VI
Obligations
Lessee shall at its expense, excepting those expenses over Fifty
Dollars ($50), maintain and keep the premises and electrical fixtures in
good repair and good condition. Lessor shall have completed all major repairs
before occupancy by Lessee. Major repairs shall be made at expense of Lessor.
For purposes of this:lease, major repairs are defined as those costing in
excess of Fifty Dollars ($50), and must be completed within five working days
after reported to Lessor. Major repairs delayed beyond the period specified
may be performed by Lessee with reimbursement therefor to be made to Lessee
by Lessor.
ARTICLE VII
