HomeMy WebLinkAbout16858 RES - 02/10/1982A RESOLUTION WHEREAS, Mustang Island is an important residential, commercial, recreation, environment, and economic resource to the Carpus Christi area; and WHEREAS, a substantial portion of Mustang Island is owned and managed by Government, including the beach front property which is governed by the Texas open beaches law; and WHEREAS, significant development exists on private property on Mustang Island, including buildings, utility systems, and other urban infrastructure; and WHEREAS, the report entitled Alternative Policies for Protecting Barrier Islands and Draft Envir'onmental Impact Statement prepared by the U.S. Department of the Interior in 1980 erroneously proposed to list Mustang Island as undeveloped, as it failed to consider the substantial acreage owned and managed by Government; and WHEREAS, the report further erroneously proposed to omit Mustang Island from the proposed list of protected islands, as it failed to consider the public ownership of the Gulf beaches throughout Texas; and WHEREAS, the City Council adopted Resolution No. 15434 on March 26, 1980, urging the Secretary of the Interior to recommend the low level alternative described in the report continuing those programs administered by federal agencies affecting barrier islands which are reasonable and workable, and urging the U.S. Congress to reject any proposal for barrier islands which would prohibit development, which would prohibit federal assistance to the repair of property damage by a natural disaster, or which would prohibit the sale of National Flood Insurance; and WHEREAS, a new draft proposal dated January, 1982, of the U.S. Department of the Interior would include all of Mustang Island north of Mustang Island State Park and south of the City of Port Aransas within the boundary of undeveloped coastal barriers; and WHEREAS, designation of Mustang Island as an undeveloped coastal barrier would lead to a ban on the sale of National Flood Insurance in the area so designated, and would no doubt lead to future efforts by federal agencies to prevent further development and to eliminate existing develop- ment; 16858 micRofiLmEo SEP 28 1984 ..4 NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Chairman of the Coastal Barrier Task Force of the U. S. Department of the Interior be urged to correct the proposed boundaries of undeveloped coastal barriers so as to exclude Mustang Island, and thereby avoid the establishment of an unwarranted ban on the sale of National Flood Insurance and the prohibition of federal assistance and repair of property damage. SECTION 2. That the City Secretary be directed to forward copies of this Resolution to the Chairman of the Coastal Barrier Task Force of the U. S. Department of the Interior, the Secretary of the Interior, and the members of Congress representing this area. SECTION 3. The necessity to urge the federal government to correct the proposed boundaries of undeveloped coastal barriers so as to recognize the existing development and to exclude Mustang Island from said boundaries in order to avoid the establishment of an unwarranted ban on the sale of National Flood Insurance, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and taking effect and be in full force in effect from and after its passage, it is accordingly so ordained, this the 10th day of February, 1982. I certainly concur with your opinion about the Department of Interior's proposed listing of Mustang Island as an undeveloped barrier island; This Administration's proposal simply disregards the existing development on this island. The state highway, water supply, and sewer systems clearly indicate the infrastructure of this region. Furthermore, I am aware of the many commercial and residential projects that either have been completed on this island or are in the process of being completed. As you may know, I also indicated my concerns about this proposal to Mayor Luther Jones and City Council member Cliff Zarsky during a meeting in my office March 1. Currently, I am reviewing the Administration's proposal with regard to all Texas coastal barriers. I intend to comment on this issue to the Secretary of Interior. Upon motion duly made and seconded, the resolution was considered and the Council polled by the roll call vote on the declaration of emergency. The motion passed unanimously. After passage of the emergency declaration and the resolution being properly and legally before the Council, it passed unanimously on another roll call vote. The resolution expresses the sentiments of the City Council of the City of Corpus Christi with regards to the declaration of Mustang Island as an undeveloped area and it is being for- warded to you with the desire that it be given consideration as your committee deliberates on this all important item.
