HomeMy WebLinkAbout16874 ORD - 02/17/1982.41 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE ARCHITECTURAL CONTRACT WITH NEEDHAM B. SMYTH & ASSOCIATES PROVIDING FOR DESIGN AND PREPARATION OF PLANS AND SPECIFICATIONS FOR THE HEAVY EQUIPMENT BUILDING AT THE CITY OF CORPUS CHRISTI MUNICIPAL SERVICE CENTER, ALL AS MORE FULLY SET FORTH IN THE AMENDMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; APPROPRIATING OUT OF THE NO. 264 MUNICIPAL SERVICE CENTER BOND FUND THE SUM OF $19,500 APPLICABLE TO PROJECT NO. 264-72-2, HEAVY EQUIPMENT MAINTENANCE BUILDING CONSTRUCTION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the architectural contract with Needham B. Smyth & Associates providing for design and preparation of plans and specifications for the Heavy Equipment Building at the City of Corpus Christi Municipal Service Center, all as more fully set forth in the amendment, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". 1 SECTION 2. That there is hereby appropriated out of the No. 264 Municipal Service Center Bond Fund the sum of $19,500 applicable to Project No. 264-72-2, Heavy Equipment Maintenance Building Construction. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for 1 preserving public property by executing the above described amendment to an existing architectural contract and by appropriating the sums necessary for the said amended contract, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this M day of February, 1982. Smyth Associated, hereinafter called "Architect", agree to the following amendment to the contract for architectural services approved by Ordinance No. 14311 on May 5, 1978. 1. Services to be Performed The Architect also hereby agrees, at his own expense, to perform all architectural, structural, mechanical, electrical and related design plans and specifications for the construction of a Heavy Equipment Building at the Service Center operated by the City of Corpus Christi. 2. Scope of Project The project includes the construction of three maintenance buildings in the City's Service Center. (Partial programming phase of the third or Heavy Equipment Building will be by the City. * 3. III. The City has the following funds for the project which include building construction, related parking, fees and contingencies: A. Wastewater Maintenance Building B. Park Maintenance Building C. Heavy Equipment Building $225,000 $360,000 $280,000 Of the above amount, $750,000 is available for construction. 4. Payment of Fees for Basic Services The City agrees to pay the Architect for his services in the design and related work for the Heavy Equipment Building a fee of 7.75% of the estimated cost of construction until such time as the actual cost of construction has been determined by the letting of a contract, from and after which date the actual cost of construction as determined by the contract price shall be used.
