HomeMy WebLinkAbout16884 ORD - 02/17/19823 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF STEVE DEAN BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A ONE -ACRE TRACT OUT OF A PORTION OF THE GREGORIO FARIAS PORTION OF THE BARRANCO BLANCO GRANT, MORE FULLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-16" ONE -FAMILY DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Steve Dean for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, February 17, 1982, at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That the zoning of that tract described as being a one -acre tract out of a part of the Gregorio Farias portion of the Barranco SER7:98 3;8194;4 16.884 WIRARUIJI.MED Blanco Grant, situated on the north side of Up River Road approximately • 500 feet east of U.S. Highway 77, in the City of Corpus Christi, Nueces County, Texas, more fully described hereafter, be changed from "R -1B" One -family Dwelling District to "6-4" General Business District: All that certain property situated in Nueces County, Texas, described as follows, to -wit: A tract of land containing 1.00 acre, being West 1.00 acre of E. 2.00 acres of a 5 acre tract conveyed to B. W. Lanfair et ux by A. B. Ault et ux by deed dated March 14, 1947, recorded in Vol. 361, Page 20, Deed Records of Nueces County, Texas, and being a part of a 70 acre tract conveyed to Mary Bickham by Alice L. Magee et al by deed dated September 7, 1909, recorded in Vol. 94, Page 279, Deed Records of Nueces County, Texas, being situated about 14 miles N. 70 deg. W. from County Seat, being a part of Gregorio Farias portion of Barranco Blanco Grant, and described by metes and bounds as follows: Beginning at a point in SE boundary line of Mary Bickham 70 acre tract, being center line of Old Up River Road, the SW corner of a tract of land embracing the E. 1.00 acre of said Lanfair 5 acre tract for SE corner of this tract, whence a one inch iron pipe set 12 inches under ground, the SE corner of said Lanfair 5 acre tract, bears N. 53 deg. 45' E. along said center line of Up River Road 182.67 feet; THENCE, with said SE boundary line of Mary Bickham 70 acre tract and of said Lanfair 5 acre tract along said center line of Up River Road, S. 53 deg. 45' W. 142.58 feet to a 3/4 inch bar set 6 inches under ground at a bend or point of deflection in center line of said roadway and; THENCE, S. 59 deg. 23 W. 30.78 feet to a point for SW corner of this tract; THENCE, N. 13 deg. 23' W. parallel with E. boundary line of said Mary Bickham 70 acre tract and of said Lanfair 5 acre tract, at 31.41 ft. a one inch iron pipe set flush with the ground in NW boundary line of ROW of said Up River Road, being 30.00 ft. northwesterly measured at right angles from said center line thereof, in all 274.01 ft. to a one inch iron pipe set flush with the ground in NW boundary line of said Lanfair 5 acre tract for NW corner of this tract; THENCE, N. 57 deg. 31' E. with said NW boundary line of Lanfair 5 acre tract, 170.15 ft. to a one inch iron pipe set flush with the ground, the NW corner of said E. 1.00 acre tract of Lanfair 5 acre tract for NE corner of this tract; THENCE, S. 13 deg. 23' E. with W. boundary line of said E. 1.00 acre tract at 232.60 ft. a one inch iron pipe set flush with the ground in said NW boundary line of ROW of Up River Road, being 30.00 ft. northwesterly measured at right angles, from said center line thereof, in all 265.16 ft. TO PLACE OF BEGINNING and containing an area of 1.00 acre. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or reso- lutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 17th day of February, 1982.
