HomeMy WebLinkAbout16896 ORD - 02/24/1982AN ORDINANCE CLOSING AND ABANDONING THE 130 FOOT INTERIOR PORTION OF THE 10 x 220' UTILITY EASEMENT IN LOT 1, BLOCK 1, COUNTRY ESTATES UNIT 10, AS SHOWN BY PLAT RECORDED IN VOLUME 47, PAGE 29, NUECES COUNTY MAP RECORDS; PROVIDING FOR REPLATTING AT THE EXPENSE OF THE ABUTTING PROPERTY OWNERS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot utility easement in Lot 1, Block 1, Country Estates Unit 10, as shown by plat recorded in Volume 47, page 29, Nueces County Map Records; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon a portion of said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described portion of a 10' x 220' utility easement in Lot 1, Block 1, Country Estates Unit 10, as shown by map recorded int'Volume 47, page 29, Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, said portion of easement being described as follows: Starting at the Westernmost corner of said Lot 1, which is in the Southeast right-of-way line of Brookside Drive, thence 560 deg. 03' E 394.53 feet along a Southerly boundary line of said Lot 1 to a point; then N29 deg. 5635" E.as measured along the centerline of said 10' utility easement, a distance of 90.00 feet to a point of Beginning of said centerline of 10 foot utility easement herein described. THENCE along the centerline of said 10 foot utility easement N29 deg. 5635" E,130.00 feet to the point of termination of the centerline of said 10 foot utility easement. Said closing and abandonment is to be subject to replatting by the abutting property owners delineating said closure. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City COuncil that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by abandoning the above described MICROFILMEIY• 16836 , SEP 28 19g4 portion of a utility easement, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the .25/ day of February, 1982.
