ABANDONING AND RELEASING THE UNUSED 15 -FOOT
UTILITY EASEMENT IN BLOCK 8, PORTAIRS ADDITION;
DECLARING VOID AND RELEASING LANDOWNER'S OBLIGA-
TIONS FOR REMOVAL OF EXISTING UTILITIES IN_THE
BLOCK; ACCEPTING A 20 -FOOT UTILITY EASEMENT IN
BLOCK 8, PORTAIRS'ADDITION; AND DECLARING AN
EMERGENCY.
WHEREAS, Sam Susser, developer of Block Eight (8), PORTAIRS
ADDITION, an Addition to the City of Corpus Christi, Texas, made
application to the City Council of Corpus Christi, Texas, for
the closing of an unopened alley twenty (20) feet in width
extending from Alexander Street to Gollihar Street, in Block Eight
(8) of the PORTAIRS ADDITION, located between Ayers Street and
Kilgore Street, in said Addition to the City of Corpus Christi,
Nueces County, Texas; and
WHEREAS, due notice having been given as provided by Charter
and a hearing held thereon, the City Council of the City of
Corpus Christi, Nueces County, Texas, by Ordinance No. 5762,
dated May 11, 1960, closed all of the aforesaid alley between
Lots One (1) through Sixteen (16) and Lots Seventeen (17) through
Thirty-two (32), all in Block Eight (8), PORTAIRS ADDITION, an
Addition to the City of Corpus Christi, Texas; and
WHEREAS, Sam Susser was to provide the City of Corpus Christi,
Nueces County, Texas, with a new utility easement in Block Eight
(8), PORTAIRS ADDITION, an Addition to the City of Corpus Christi,
Texas; and
WHEREAS, Sam Susser did. dedicate a new utility easement to
the City of Corpus Christi, Texas, over and through a portion of
Block Eight (8), PORTAIRS ADDITION, an addition to the City of

Corpus Christi, Nueces County, Texas; which said easement is
recorded in Volume 889, Pages 542-543, Deed Records, Nueces County,
Texas; and
WHEREAS, Sam Susser was to remove and relocate the utility
installations located in said alley being closed at his own cost
and expense; which said relocation remains to be implemented; and
WHEREAS, Sam Susser has proposed that the dedicated fifteen -
foot (15') utility easement created pursuant to City of Corpus
Christi Ordinance No. 5762 and the "Indenture" recorded in Volume
889, Pages 539-541 of the Deed Records of Nueces County, Texas,
be abandoned, as no existing use is presently being made of said
easement and no use has been made of said easement since the
dedication and placing of record of said easement, and that the
obligations of Sam Susser to the City of Corpus Christi, Texas,
set forth in that one certain "Indenture" recorded in Volume 889,
Pages 539-541 in the Deed Records of Nueces County, Texas, be voided
and released in exchange for the dedication and delivery by Sam
Susser of a twenty -foot (20') utility easement in recordable form
to the CitY.of Corpus Christi, Texas, over and through said alley
closed by City of Corpus Christi Ordinance No. 5762 on May 11,
1960; and
WHEREAS, it has been determined by the Council of the City
of Corpus Christi that no use has been made of the easement
dedicated by Sam Susser recorded in Volume 889, Pages 542-543 in
the Deed Records of Nueces County,, Texas, since the date of the
dedication of said easement and its recording; that many members
of the public are presently being served by the City of Corpus
Christi, Texas, and by private utilities through existing lines
installed in the alley closed by City of Corpus Christi Ordinance
No. 5762 on May 11, 1960 without express grant of right for such
use being of record with the County Clerk of Nueces County,
Texas; that it would not be in the public interest for the
obligations remaining to be performed by Sam Susser under the
"Indenture" recorded in Volume 889, Pages 539-541, Deed Records,
Nueces County, Texas, to be implemented at this time; and that it
is in the public interest for the easement of record in Volume
889, Pages 541-542, Deed Records, Nueces County, Texas, to be
released and abandoned by the City of Corpus Christi, Texas; and
that the obligations of Sam Susser to remove the existing City of
Corpus Christi utility lines and private utility lines in the
alley closed by Ordinance No. 5762 at his cost and expense be
voided and released in return for a new twenty -foot (20') utility
easement from Sam Susser to the City of Corpus Christi, Texas,
over and through the former alley closed under the terms of
Ordinance No. 5762 on May 11, 1960;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the unused utility easement from Sam Susser
to the City of Corpus Christi, Texas, a municipal corporation,
duly incorporated by special act of the Legislature of the State
of Texas, now of record in Volume 889, Pages 541-542, Deed Re-
cords, Nueces County, Texas, is hereby released and abandoned and
the City Attorney of the City of Corpus Christi, Texas, is hereby
directed to prepare an appropriate release of said easement being
abandoned in recordable form for delivery to Sam Susser.
SECTION 2. That the obligations of Sam Susser, as party of
the First Part, to the City of Corpus Christi, Texas, acting
through its City Manager, as party of the Second Part, in that
one certain "Indenture" recorded in Volume 889, Pages 539-541,
Deed Records, Nueces County, Texas, specifically as set out in
Paragraphs One (1), Two (2), and Four (4) of said Indenture are
hereby released and voided and declared to be of no further force
and effect as of the effective date of this Ordinance.
SECTION 3. That a new twenty -foot (20') utility easement in
recordable form, approved as to form by the City Attorney of the
City of Corpus Christi, Texas, be dedicated by Sam Susser to the
City of Corpus Christi, Texas, a municipal corporation, duly
incorporated by special act of the Legislature of the State of
Texas, over the alley closed by Ordinance No. 5762 on May 11,
1960, being said twenty -foot (20') alley extending from Alexander
Street to Gollihar Street, Block Eight (8), PORTAIRS ADDITION, an
Addition to the City of Corpus Christi, Texas, said alley being
located between Ayers Street and Kilgore Street; all in said
Block Eight (8), PORTAIRS ADDITION, an Addition to the City of
Corpus Christi, Texas, and that said easement be approved as to
form by the City Attorney of the City of Corpus Christi, Texas,
and be executed and delivered to the City of Corpus Christi,
Texas, contemporaneously with the passage of this Ordinance and
promptly recorded in the Deed Records of Nueces County, Texas.
SECTION 4. That upon written request of the Mayor or
five Council members, copy attached, to find and declare an
emergency due to the need for efficient administration of City
affairs by closing the aforesaid utility easement in considera-
tion of receipt of a 20 -foot utility easement, all as aforesaid,
such finding of an emergency is made and declared requiring sus-
pension of the Charter rule as to consideration and voting upon
ordinances or resolutions at three regular meetings so that this
ordinance is passed and shall take effect upo first reading as
an emergency measure this the -...314e'day of

KNOW ALL MEN BY THESE PRESENTS:
THAT we, Sam Susser and wife, Minna S. Susser, of the County
of Nueces, State of Texas, for and in consideration of the sum of
Ten ($10.00) Dollars to us in hand paid by the City of Corpus
Christi, Nueces County, Texas, the receipt of which is hereby
acknowledged, have GRANTED and CONVEYED, and by these presents
do GRANT and CONVEY unto the City of Corpus Christi, Texas, a
municipal corporation duly incorporated under and by virtue of
the laws of the State of Texas, its successors and legal repre-
sentatives, the free and uninterrupted use, liberty, privilege,
and easement of going in, on, over, under, and along a certain
tract of land located in Nueces County, Texas and being described
as follows:
A 20.00 foot wide utility easement (formerly a 20.00 foot
wide alley) out of Block 8, Portairs Addition, a map of
which is recorded in Volume 9, Page 27, Map Records of
Nueces County, Texas:
BEGINNING at a point on the Northeast right-of-way of
Gollihar Road for the South corner of Lot 16, Block 8 of
said Portairs Addition and the West corner of this easement;
THENCE North 28°10'00" East,along the Southeast lot lines
of Lots 16-4, Block 8 of said Portairs Addition, 647.02
feet for a corner of this easement;
THENCE South 61°40'00" East 10.00 feet for an inside corner
of this easement;
THENCE North 28010'00" East 150.00 feet to a point for the"
Southwest right-of-way of Alexander Street for the North
corner of this easement;
THENCE South 61040100" East, along said Southwest right-of-
way, 10.00 feet for the East corner of this easement;
THENCE South 28010100" West, along the Northwest lot lines
of Lots 32-17, Block 8 of said Portairs Addition, 797.02
feet to a point on the aforementioned .Northeast right-of-
way of Gollihar Road for the South corner of this easement;
THENCE North 61°40'00" West, along said Northeast right-of-
way, 20.00 feet for the POINT OF BEGINNING and containing
14,440.34 square feet of land;
A map of which is marked "Exhibit A", and attached hereto
and made a part hereof for all purposes.
Together with the free ingress, egress and regress to and
for the City of Corpus Christi, Texas, for the purpose of
constructing, laying and keeping public utility lines, and for
the purposes of maintaining, servicing, repairing, and inspecting
said lines under, on and along said tract.
TO HAVE AND TO HOLD, all and singular, the rights and
privileges aforesaid to the City of Corpus Christi, Texas, its
successors and legal representatives, for the proper use as a
utility easement and utility right-of-way, for so long as used
for such purposes, and if the use for said easement and way of •
said uses be ever abandoned, then, in :that event, the aforesaid
rights and privileges shall cease.

of Nueces, State of Texas, for and in consideration of the sum of
Ten ($10.00) Dollars to us in hand paid by the City of Corpus
Christi, Nueces County, Texas, the receipt of which is hereby
acknowledged, have GRANTED and CONVEYED, and by these presents
do GRANT and CONVEY unto the City of Corpus Christi, Texas, a
municipal corporation duly incorporated under and by virtue of
the laws of the State of Texas, its successors and legal repre-
sentatives, the free and uninterrupted use, liberty, privilege,
and easement of going in, on, over, under, and along a certain
tract of land located in Nueces County, Texas and being described
as_ follows:
A 20.00 foot wide utility easement (formerly a 20.00 foot
wide alley) out of Block 8, Portairs Addition, a map of
which is recorded in Volume 9, Page 27, Map Records of
Nueces County, Texas:
BEGINNING at a point on the Northeast right-of-way of
Gollihar Road for the South corner of Lot 16, Block 8 of
said Portairs Addition and the West corner of this easement;
THENCE North 28°1000" East, along the Southeast lot lines
of Lots 16-4, Block 8 of said Portairs Addition, 647.02
feet for a corner of this easement;
THENCE South 61°4000" East 10.00 feet for an inside corner
of this easement;
THENCE North 28°10'00" East 150.00 feet to a point for the
Southwest right-of-way of Alexander Street for the North
corner of this easement;
THENCE South 61°4000" East, along said Southwest right-of-
way, 10.00 feet for the East corner of this easement;
THENCE South 28°1000" West, along the Northwest lot lines
of Lots 32-17, Block 8 of said Portairs Addition, 797.02
feet to a point on the aforementioned Northeast right-of-
way of Gollihar Road for the South corner of this easement;
THENCE North 61°40'00" West, along said Northeast right-of-
way, 20.00 feet for the POINT OF BEGINNING and containing
14,440.34 square feet of land;
A map of which is marked "Exhibit A", and attached hereto
and made a part hereof for all purposes.
Together with the free ingress, egress and regress to and
for the City of Corpus Christi, Texas, for the purpose of
