BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a lease agreement with the Corpus Christi Independent School District for the use of Washington Elementary School for the continued operation of a multipurpose senior center, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and deClare an emergency due to the need for'efficient administration of City affairs by executing the agreement for continued operation of the multipurpose senior center for elderly citizens of the community, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances and resolutions at three regular meetings so that this ordinance is passed64 and shall take effect upon first reading as an emergency measure this /64E' day of March, 1982. BRUCE AYCOCK, CI' ATTOR Y By 73714t...e, C14 MAY 1_6mo THE TY OF CORPUS CHRISTI, TEXAS SEP 2 8 1984 VACROVINED LEASE AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES I This Lease Agreement, by and between the Corpus Christi Independent School District, hereinafter referred to as the "District" and the City of Corpus Christi, Texas, a municipal corporation and body politic, operating under the home rule statutes of the State of Texas hereinafter referred to as "City". W ITNESSET H: WHEREAS, City desires the responsibility of continuing a multipurpose center at the building known as the Booker T. Washington Elementary School; and WHEREAS, said building is adequately serving the elderly population as a senior center as well as providing other needed services; and WHEREAS, said building is presently unused by District; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and District do enter into the following agreement: District agrees to lease said building known as the Booker T. Washington Elementary School to City for a term of three (3) years, beginning April 1, 1982, and terminating March 31, 1985. City is also granted an option to extend said lease for an additional three (3) year term. In the event Lessee exercises such option of renewal, then Lessee shall give Lessor written notice of such intention to renew at least thirty (30) days prior to the expiration of this lease. City agrees to pay as consideration for said lease, the sum of $1.00, receipt of which by District is hereby acknowledged. 11 City shall assume the responsibility for.payment of all utilities and shall perform routine maintenance on said building. City further agrees to maintain liability and property damage insurance in amounts equivalent to its general coverage. 111 City shall have the right to sublease any portion of the school building for the delivery of community services, subject to approval of .District. IV District shall allow the use of all equipment and furniture presently within the building, provided that District may remove furniture and equipment for use elsewhere in the District as the need arises. V Any major modifications to the building or grounds by City shall be subject to approval by District. VI Either party hereto may cancel this lease by giving the other party sixty (60) days written notice. Notice under this section may be served on the City by certified mail at P. 0. Box 9277, Corpus Christi, Texas 78408, and served on the District by certified mail at 801 Leopard, Corpus Christi, Texas 78401. VII City shall return building to District in the same condition as received except for usual wear and tear, and any such modifications as agreed to provided by Section V above. VIII. , City and District mutually agree that the agents and employees of each shall not be considered agents and employees of the other and neither City nor District shall be liable for injury sustained byran agent or en'- . •_ _ _ ployee of the other.
