FOR PLACING AN INSULATED CABLE ON EXISTING SOUTHWESTERN BELL TELEPHONE COMPANY POLES IN PUBLIC UTILITY EASEMENT IN LOTS 1 THROUGH 13 AND 16 THROUGH 30, BLOCK 7, DEL MAR SUBDIVISION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a revocable easement to South Texas Retina Consultants, P.A. for the placing of an insulated cable on existing Southwestern Bell Telephone Company poles in the 10 foot wide public utility easement in Lots 1 through 13 and 16 through 30, Block 7, Del Mar Subdivision, in the City of Corpus Christi, all as more fully set forth in the revocable easement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid revocable easement, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances and resolutions at three regular meetings so that this ordinance is passed and a11 take effect upon first reading as an emergency measure the /0 ATTEST: day of March, 1982. y Secre ary APPRRUZD: /0 DAY OF MARCH, 1982 . Martin, for and in consideration of the sum of One Dollar ($1.00) to it in hand paid by Dr. Charles H. Campbell, President of South Texas Retina Consultants, P.A., hereinafter referred to as "Owner", the receipt of which is hereby acknowledged and confessed, has granted, sold, and conveyed, and by these presents does Grant, Sell and Convey, upon the conditions herein stated, unto the said Owner, the right to install and operate one insulated aerial cable in the 10 foot wide utility easement in Lots 1-13, 16-30, Block 7, Del Mar Subdivision for the purpose of connecting a computer system, through said cable. NOW, THEREFORE, the City and Owner agree as follows: 1. The City offers no objection and hereby grants permission to 'place or install said cable within said easement subject to the City's rigilts to operate and/or maintain public utilities. The subject easement is shown on - attached Exhibit "A". _a 2. Grantee shall make appropriate installation arrangements with Southwestern Bell Telephone Company or other owner of the structures upon which the cable will be installed. 3. The Owner will save and keep harmless the City -from any and all claims for liability by reason of the installation of said cable.-- ' 4. It is understood and agreed that the rights herein granted may be revoked at any time by the City, and the Owner may be requiredtoremove said cable upon ninety (90) days notice in writing. 5. All rights granted hereby shall be subordinate to all uses the City or other public utility user or users may make of such tuility easement for public purposes. 6. The Revocable Easement shall become effective and shall be binding upon and shall inure to the benefit of the, parties hereto and their respective heirs, successors and assigns from and after the date of execution.
