AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS
NECESSARY FOR ACQUISITION OF A UTILITY EASEMENT;
APPROPRIATING $1,300; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
- SECTION 1. That the City Manager be and he is hereby authorized
to execute documents necessary for the acquisition of a utility'easement from
Alta Faye Elledge in connection with the Lakeview Acres Sanitary Sewer Extension,
Project No. 250-77-37, said easement being described as follows:
Being a tract of land out of Lot 5, Block 1, Lake View
, Acres, as shown by map of records in Volume 14, Page 47,
Map Records, Nueces County, Texas, and more particularly
described by metes and bounds as follows:
BEGINNING at the southwest corner of said lot;
THENCE North 29 deg. East, along the northwest line of
said lot, a distance of 361.02 feet;
THENCE South 61 deg. East, a distance of 15.00 feet;
THENCE South 29 deg. West, a distance of 361.66to a
point on the southwesterly line of said lot;
THENCE along a curve concave to the left having an
initial tangent bearing North 56 deg. 0458" West,
with a central angle 4 deg. 5502" and a radius of
175.0 feet, a distance of. 15.02 feet to the point
of beginning;
And containing 0.125 acres, more or less.
Together with a 20' temporary construction easement
east of and adjacent to abovementioned permanent
easement to be used for working room and storage of
materials during construction phase. Said temporary
easement to be abandoned upon completion of project.
SECTION 2. That there is hereby appropriated $1,300 from the
No. 250 Sanitary Sewer Bond Fund for the acquisition.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached to find and declare an emergency due to the need for
efficient administration of City.affairs by the acquisition of the aforesaid
parcel, such finding of an emergency is made and declared requiring suspension
of the Charter rule as to consideration and voting upon ordinances or resolutions
at three regular meetings so that this ordinance is passed and shall take effect

the City of Corpus Christi, Nueces County, Texas,

presents does (do) grant and convey unto the City of Corpus Christi,
Texas, a municipal corporation duly incorporated under and by virtue
of the laws of the State of Texas, its successors and legal represen-
tatives the free and uninterrupted use, liberty, privilege, and ease-
ment of going in, on, over, under and along a certain tract of land
situated in Nueces County, Texas and being described as follows:
Being a tract of land out of Lot 5, Block 1, Lake
View Acres, as shown by map of records in Volume
14, Page 47, Map Records, Nueces County, Texas,
and more particularly described by metes and
bounds as follows:

Thence N. 29° E., along the northwest line of said
lot, a distance of 361.02 feet;
Thence S. 61° E., a distance of 15.00 feet;
Thence S. 29° W., a distance of 361.66' to a point

Thence along a curve concave to the left having an
initial tangent bearing N. 56° 04' 58"W., with a
central angle 40 55 02" and a radius of 175.0
feet, a distance of 15002 feet to the point of
beginning;
And containing 0.125 acres, more or less.
Together with a 20' temporary construction easement
east of and adjacent to abovementioned permanent
easement to be used for working room and storage of
materials during construction phase. Said temporary
easement to be abandoned upon completion of project.

Grantee, upon completion of abovementioned project will put said tempor-
ary construction easement area in as was or better condition.
A map of which is marked "Exhibit A", and attached hereto and made a
part hereof for all purposes.
Together with the free ingress, egress, and regress to and for the City
of Corpus Christi, Texas, for the purpose of constructing, laying, and
keeping public utility lines, and for the purposes of maintaining,
servicing, repairing, and inspecting said lines under, on, and along
said tract.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges afore-
said to the City of Corpus Christi, Texas its successors and legal
representatives, for the proper use as a UTILITY EASEMENT and utility
right -of -Way for so long as used for such purpose, and if the use for
said easement and way of said uses be ever abandoned, then in that
event, the aforesaid rights and privileges shall cease.
