HomeMy WebLinkAbout16948 ORD - 03/17/1982jkh:5-12-82;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF WILLARD HAMMONDS BY .CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1, 2 AND 3, BEING A PORTION OF LOTS 13, 14, 15, --T6, 17.AND 18, SECTION 31, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS FROM "R-16" ONE FAMILY DWELLING DISTRICT TO "A-1" APART- MENT HOUSE DISTRICT ON RACT 1 AND TO "R-2" MULTIPLE c_DWEiLING DISTRICT ON TRACTS 2 AND 3 AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Hillard Hammonds for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday March 17, 1982 , at Regular Council meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF . CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning of Tracts 1, 2 and 3, being a portion of Lots 13, 14, 15, 16, 17 and 18, Section 31, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas be and the same is hereby changed from "R-18" One Family Dwelling District to "A-1" Apartment House District on Tract 1 and to "R-2" Multiple Dwelling District on Tracts 2 and 3, said parcels or tracts being described as follows: SEP 28 1984 miGROFILMED TRACT 1 Being a 21.7 acre tract of land, more or less, out of Lots 14, 15, 16, 17, 18, Section 31, Flour Bluff and Encinal Farm and Garden Tracts' a map of which is recorded in Volume A, pages 41, 42, 43,map records of Nueces County, Texas; said 21.7 acre tract, its northeast boundary line is coincident with the southwest boundary line of the U. S. Navy Radio Facility site fronting South Padre Island Drive; BEGINNING at a point on said Southwest line of the U.S. Navy Radio Facility site for the North corner of this tract from which corner the West corner of said Facility site bears North 61°00'25" West 381.23 feet, and the South corner of Block C, Peary Place Unit 1, a map of which is recorded in Volume 25, Page 73 Bears North 61°00'25" West 381.23 feet and North 28°59'35" East 121.07 feet; THENCE South 61°00'25" East, along the aforementional Southwest line, 420.00 feet, more or less, to a point on the shoreline of Cayo Del Oso, for the East corner of this tract; THENCE with said shoreline, South 26°00'25" West 352.40 feet, more or less, for a corner of this tract; THENCE South 499.80 feet, more THENCE South 686.34 feet, more THENCE North of this tract; THENCE North tract; 15001'00" West, continuing on the shoreline of Cayo Del Oso, or less, for a corner of this tract; 05°00'00" West, continuing on the shoreline of Cayo Del Oso, or less, for the South corner of this tract;. 6100000" West 1,287.99 feet, more or less for the West corner 2900000" East 215.00 feet, more or less, for a corner of this THENCE North 0503000" West 205.00 feet, more or less, to a point on a curve which has a central angle of 4500800", a radius of 400 feet, a tangent,distance of 166.23 .feet and an arc length of 315.09 feet ; THENCE with said curve to the_right, an arc distance of 175.09 feet, more or less, for the point of tangency; THENCE South 61°00'00" East, 455.00 feet, more or less, for the point of curvature of a circular curve to the left which has a central angle of 104000'00", a radius of 145.00 feet, a tangent distance of 185.59 feet, and an arc length of 263.20 feet; THENCE with said curve to the left, an arc distance of 263.20 feet, more or less, for the point of tangency; THENCE North 15°00'00" East, 260.00 feet, more or less, for the point of curvature of a circular curve to the left which has a central angle of 760001001, a radius of 350.00 feet, a tangent distance of 273.45 feet, and an arc length of 464.26 feet; THENCE with said curve to the left, 284.26 feet, more or less, for a corner of this tract; THENCE North 5300000" East, 125.00 feet, more or less, for a corner of this tract; THENCE North 29°0000" East, 300.00 feet, more or less, to the POINT OF BEGINNING. -2- TRACT 2 Being a 9.8 acre tract of land, more or less, out of Lots 14, 15, 16, 17, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, pages 41, 42, 43, map records of Nueces County, Texas; said 9.8 acre tract, its northeast boundary line is coincident with the south- west boundary line of the U. S. Navy Radio Facility site fronting South Padre Island Drive; BEGINNING at a point on said Southwest line of the U.S. Navy Radio Facility site for the North corner of this tract from which corner the West corner of said Facility site bears North 61°00'25" West 36.23 feet, and the South corner of Block C, Peary Place Unit 1, a map of which is recorded in Volume 25, Page 73 bears North 61000125" West 36.23 feet and North 28°59'35" East 121.07 feet; THENCE South 61°00'25" East, along the Southwest line of the U.S. Navy Radio Facility site, 345.00 feet, more or less, for a corner of this tract; THENCE South 29000100" West 300.00 feet, more or less, for a corner of this tract; • THENCE South 5300000" West 125.00 feet, more or less, to a point on a curve which has a central angle of 7600000" a radius of 350 feet, a tangent distance of 273.45 feet and an arc length of 464.26 feet; THENCE with said curve to the right, an arc distance of 284.26 feet, more or less, for the point of tangency; THENCE South 15000100" West, 260.00 feet, more or less, for the point of curvature of a circular curve to the right which has a central angle of 1040001001,, a radius of 145.00 feet, a tangent distance of 185.59 feet and an arc length of 263.20 feet; THENCE with said curve to the right, an arc distance of 263.20 feet, more or less, for the point of tangency; THENCE North 61000100" West, 380.00 feet, more or less, for the West corner of this tract; THENCE North 29°00'00" East, 1,057.00 feet, more or less, to the POINT OF BEGINNING. TRACT 3 Being a 2.3 acre tract of land, more or less, out of Lots 17, 18, Section 31, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, pages 41, 42, 43, map records of Nueces County, Texas, and a 10.00 foot strip of right of way out of Moffett Drive as dedicated by Peary Place Unit 2, a map of which is recorded in Volume 28, page 12 of said map records of Nueces County, Texas; BEGINNING at a point on the proposed centerline of Moffet Drive to be widen to a 60.00 foot right-of-way which proposed centerline is 10.00 feet South of the existing centerline of Moffet Drive (40.00 feet wide, as dedicated by said Peary Place Unit 2) for the North corner of this tract from which corner the existing centerline intersection of Moffet Drive and Merriman Drive bears North 73°52'00" East 100.00 feet and North 16°08'00" West 10.00 feet; THENCE North 73°52'00" East, along the proposed centerline of Moffet Drive parallel to the existing centerline thereof and 10.00 feet distant therefrom, measured at right angles thereto, 120.00 feet, more or less, to a point of curvature of a circular curve to the right which has a central angle of 4500810011, a radius of 400.00 feet, a tangent distance of 166.23 feet and an arc length of 315.09 feet; THENCE with said curve to the right, 140.00 feet, more or less, for the east corner this tract; THENCE South 0503000" East, 205.00 feet, more or less, for a corner of this tract; • THENCE South 29°00'00" West. 215.00 feet, more or less, for the South corner of this tract; THENCE North 61°00'00" West 325.00 feet, more or less, for the Nest corner of this tract; THENCE North 29°00'00" East 232.00 feet, more or less, to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of 440) , 19 ATTEST: Ci y Secretary MAYOR APPRiap: tivc,--DAY OF J.
