HomeMy WebLinkAbout16985 ORD - 04/07/1982AN ORDINANCE AMENDING THE ORDINANCE APPLICABLE TO THE LEXINGTON ESTATES HAHAN ACRES STREET IMPROVEMENT PROJECT TO REFLECT THE LEGAL AND CURRENT INTEREST RATE OF SIX AND ONE HALF (611%) PERCENT PER ANNUM ON UNPAID IN— STALLMENTS, WHICH RATE IS THAT SET BY LAW AND CUR— RENTLY IN EFFECT; AND DECLARING AN EMERGENCY. WHEREAS, On the 24th day of September, 1980, the City Council, by enactment of Ordinance No. 15779 amended the City Code and assessment policy by raising the interest rate on unpaid installments for pavement assessments from five and one fourth (51/47.) percent to six and one half (61/2%) percent per annum. WHEREAS, Ordinances Nos. 15922, 15923, 15994, 15995, 16804, and 16805 were passed in regard to improvements of the following streets: 1. Brandesky, Cosner and Kosarek Drives, from McArdle Road to South Padre Island Drive 2. Foley Drive, from Kostoryz Road to Broughton Drive, and 3. Hakel Drive, from McArdle Road to Mahan Drive. WHEREAS the above Ordinances Nos. 15922, 15923, 15994, 15995, 16804, and 16805 were passed utiliting a lower interest rate than the six and one half (61/2%) percent per annum currently allowed by law, and currently in effect; NOW THEREFORE, BE IT ORDAINED BY THE CITY.COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 15922, passed and approved on December 10, 1980, be amended by amending Section 2, Paragraph B of said Ordinance wherein the method of payment is described so as to state an interest rate of six and one half (61/2%) percent per annum. That Ordinance No. 15994, passed and approved on January 28, 1981, be amended by amending Section Five wherein the method of payment of assessments is stated, so as to state an interest rate of six and one half (61/2%) percent per annum. That as to Ordinances Nos. 15922, 15923, 15994, 15995, 16804, and 16805, that any and all references to the interest rate applicable to unpaid paving assessments be amended to state an applicable interest rate of six and one half (61/2%) percent per annum. 1_6985 7,s 000t10'). The City Secretary of the City of Corpus Christi is hereby authorized and directed to prepare a notice in the name of said City of action taken herein and to have same filed by the County Clerk of Nueces County, Texas, among the Mortgage Records of said County. SECTION 3. That upon written request of the Mayor or five Council Members, copy attached, to find and declare an emergency due to the need to amend the ordinances so that the rate charged will be in conformity with current law, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall take ffect upon first reading as an emergency measure this the day of , 1982.
