HomeMy WebLinkAbout16990 ORD - 04/07/1982AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF DR. JOHN B. SOHOCKI AND BILLY D. BRUNSON BY AMENDING THE ZONING MAP WITH REFERENCE TO TRACT 1, CONSISTING OF 1.53 ACRES AND TRACT 2, CONSISTING OF 4.47 ACRES, OUT OF FALLIN'S RIVERSIDE SUB- DIVISION, FROM "R-16" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT ON TRACT 1 ANO TO "B-3" BUSINESS DISTRICT ON TRACT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Dr. John B. Sohocki and Billy D. Brunson for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, April 7, 1982, at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That the zoning of Tract 1, being out of Lot 7, Block 1, Fallin's Riverside Subdivision, and Tract 2, being out of Lots 7 and 5, Block 1, Fallin's Riverside Subdivision, more fully described hereinafter, be and the same is hereby changed from "R -1B" One -Family Dwelling District to "R-2" Multiple Dwelling District on Tract 1 and to "9-3" Business District on Tract 2, said tracts being described by metes and bounds as follows: TRACT I Being a tract of land situated in Corpus Christi, Nueces County, Texas, on Callicoatte Road, containing 1.53 acres, -41S NS 16990 10iY 000 more or less, out of the northerly portion of Lot 7, Block 1 of Fallin's Riverside Subdivision, as shown on map of • said subdivision of record in Volume 39, Page 38 of the Map Records of Nueces County, Texas, and being more particular- ly described by metes and bounds as follows, to -wit: BEGINNING at a 5/8 inch iron rod marking the ME corner of said Lot 7, Block 1, Fallin's Riverside Subdivision, for the NE corner of this tract, also being the SE corner of Lot 9, Block 1, Fallin's Riverside Subdivision, and the point of beginning;' THENCE S 36 deg. 10' 50" W, along the easterly boundary line of said Lot 7, Block 1, Fallin's Riverside Subdivision, a distance of 224.92 feet to a point for the SE corner of this tract; THENCE Ti 53 deg. 49' 48" W, a distance of 494.64 feet to a point in the westerly boundary line of said Lot 7, Block 1, Fallin's Riverside Subdivision, for the SW corner of this tract; THENCE N 36 deg. 10' 50" E, along the westerly boundary line of said Lot 7, Block 1, Fallin's Riverside Subdivision, and along the easterly boundary line of Callicoatte Road, a distance of 50.00 feet to a point marked by a 5/8 inch iron rod for the NW corner of this tract, also being a corner of said Lot 7, Block 1, Fallin's Riverside Sub- division; THENCE S 53 deg. 49' 10" E, along the northerly boundary line of said Lot 7, a distance of 255.0 feet to a point marked by a 5/8 inch iron rod for an inside corner of this tract, also being a corner of said Lot 7; THENCE N 36 deg. 10' 50" E, along the westerly boundary line of said Lot 7, a distance of 175.0 feet to a point marked by a 5/8 inch iron rod for a northwesterly corner of this tract, also being a corner .of said Lot 7; THENCE S 53 deg. 49' 10" E, along the northerly boundary line of said Lot 7, a distance of 239.64 feet to the point of beginning, and containing 1.53 acres of land, more or less. TRACT,II Being a tract of land situated in Corpus Christi, Nueces County, Texas, containing 4.47 acres of land, more or less, out of the southerly portion of Lot 7, Block 1 of Fallin's Riverside Subdivision, as shown on map of said subdivision of record in Volume 39, Page 38 of the Map Records of Nueces County, Texas, and 0.71 acre, more or less, out of the northeasterly portion of Lot 5 of Fallin's Riverside Subdivision, as shown on map of said subdivision of record in Volume 4, Page 60 of the Map Records of Nueces County, Texas, and being more particularly described by metes and bounds as follows, to -wit: BEGINNING at the SE corner of said Lot 7, Block 1, Fallin's Riverside Subdivision for the SE corner of this tract and the point of beginning; ' THENCE N 53 deg. 49' 48" W, along the southerly boundary line of said Lot 7, Block 1, Fallin's Riverside Sub- division, a distance of 85.75 feet to a point marked by a 5/8 inch iron rod; THENCE N 76 deg. 44' 36" W, along the northerly boundary line of the right-of-way of said Interstate Highway No. 37, a distance of 344.16 feet to a point for the SW corner of this tract; THENCE N 18 deg. 23' 19" W, along the northerly boundary line of the right-of-way of said Interstate Highway Mo. 37, a distance of 122.19 feet to a point for a westerly corner of this tract; THENCE N 36 deg. 136 19" E, along the easterly boundary line of Callicoatte Road, a distance of 62.68 feet; THENCE S 53 deg. 49' 48" E, a distance of 8.00 feet; THENCE N 36 deg. 10' 50" E, along the westerly boundary line of said Lot 7, Block 1 and along the easterly boundary line of Callicoatte Road, a distance of 331.66 feet to a point for the NW corner of this tract; THENCE S 53 deg. 49' 48" E, a distance of 494.64 feet to a point in the easterly boundary line of said Lot • 7, Block 1, Fallin's Riverside Subdivision, for the NE corner of this tract; THENCE S 36 deg. 10' 50" W, along the easterly boundary line of said Lot 7, Block 1, Fallin's Riverside Subdivision, a distance of 331.66 feet to the point of beginning, and . containing 4.47 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. ' SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings so that this ordinance is passed and shall e effect upon first reading as an emergency measure this the y of L. , 1982.
